BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 12th day of April, 1988, with the following present: HONORABLE: Maurice Meyers Mayor Bob Lee, Jr. Councilman At Large Andrew P. Cokinos Councilman At Large Lulu L. Smith Councilman, Ward I Mike Brumley Mayor Pro-Tem Councilman, Ward II Audwin Samuel Councilman, Ward III David W. Moore Councilman, Ward IV Albert E. Haines City Manager Lane Nichols City Attorney Rosemarie Chiappetta City Clerk -000- The Invocation was given by Rabbi Peter Hyman, Temple Emanuel. The Pledge of Allegiance was led by Councilman Andrew P. Cokinos. -000- Mayor Meyers announced there will be an Executive Session following the Regular Session of City Council in accordance with Section 2(e) of the Open Meetings Act of the State of Texas to discuss pending or contemplative litigation. -000- Two Proclamations were issued: "Annual Boys Haven Crawfish Festival and Craft Show, " April 17, 1988, and "Beaumont League of Negro Business and Professional Women' s Founders Day, " April 17, 1988 . -000- Mayor Meyers announced that the Bonnie Cokinos School of Dance represented the City of Beaumont and the State of Texas in the Young American Dance Festival held in California, and as predicted, they came back winners as overall best dancers in America. They competed in ballet, tap, jazz, and a solo division. Councilman Cokinos and Councilman Lee presented individual letters of congratulations to each participant: Alicia Jordan, Tiffany Hornach, Raquel Minton, Stacey Girard, Kelli Fontenot, Stacy Heilman, Stephanie Heilman, Robin Hickman, Jana Hartman, Grace Ann Bodin, Amy Gotreaux, Stephanie Reese, Elizabeth -97- April 12, 1988 Woodhead, Tiffany Knoblach, and Angela Walters. In addition to dance ability, Mrs. Cokinos stated that the apparent charm of the girls in that they were as lovely off stage as on stage was a contributing factor. The trophy received will be kept for a year with Mrs. Cokinos returning to the Young American Dance Festival in 1989 to present it to next year' s winners. The final event was filmed by CBS Studios with Mia Peoples as Mistress of Ceremonies. Mrs. Cokinos presented Mayor Meyers with a commemorative CBS marked key chain. -000- Miss Deidra Ward and the "Sounds of Silence" invited Mayor Meyers to have lunch on April 13th with Willie Broussard, owner of Broussard' s Automotive, and other deaf citizens to enter the world of deafness. Mayor Meyers ' ears will be plugged so that he will not be able to hear during the lunch period. He has been asked to communicate with Willie, without speaking, about his lifestyle, education, business and other areas of Willie' s life and then reflect on the experience and frustrations. The "Sounds of Silence" is a group that is being used to bring about public awareness of our deaf community. -000- Dr. Richard LeBlanc, President of the Y.M.B.L, Mike Frank, Chairman of the South Texas State Fair, and Mel Wright, Rodeo Chairman explained that through proceeds of the State Fair and the Rodeo they are able to donate back to the community certain items. Today, on behalf of the 1, 500 plus members of the Y. M. B. L. they presented to the citizens of Beaumont and Southeast Texas, through the Beaumont Fire Department, "Pluggie, " an eight-channel-- mechanical robot to serve as an educational, fire preventive tool. Firefighters Tommy May and Jeff McNeel gave a demonstration of how "Pluggie" will be used in schools, at the Fire Museum, and other functions. "Pluggie" danced and sang LET'S HAVE A FIRE DRILL. -000- Public comment was invited on Agenda items A, C through E. No citizens wished to address Council regarding these items. -000- The following Consent Agenda items were considered: Approval of the Minutes of the Regular City Council Session held April 12, 1988; Resolution No. 88-74 authorizing pledge and release of $500,000 in securities held at the Federal Reserve Bank - Dallas, effective April 12, 1988; Resolution No. 88-75 appointing Dr. William Burke and Richard Carroll for terms ending December 22, 1989 and Mike Conwell with a term ending -98- April 12, 1988 December 22 , 1988 to the Sister Cities Commission, Nancy Fitzpatrick and Benjamin, Booker to the Beaumont Advisory Committee for Prevention of Child Abuse and Neglect with terms expiring June 30, 1988 and Helen McCarty to the Housing Rehabilitation Loan Board with a term expiring May 31, 1988. Resolution 88-76 authorizing final payment in the amount of $33, 183. 25 to Lupton Painting Co. for painting the exterior of the elevated water storage tank located at 13th Street and Laurel Avenue; Resolution 88-77 authorizing execution of a railroad easement to Kansas City Southern Railway Company out of Parcel 212 of the Martin Luther King, Jr. , Parkway Project for relocation of their railroad facility and a Quitclaim Deed conveying Parcel 212 of the Martin Luther King, Jr. , Parkway Project to the State of Texas, subject to the granted easement; Resolution 88-78 authorizing exeucting of Deeds Without Warranty to W. H. Marmion transferring the City of Beaumont' s interest in properties described as the N. 50 ' of Lots 1, 2 & 3, S. 90 ' of Lot 3 , W. 1/2 of Lot 2 and the W. 60 ' of Lot 7, Block C, Isaac Black Addition; Lot 1, Block 15, Blanchette 2nd Addition; and Tract 83 out of Tract 15, Plat B-3, J. W. Bullock Survey to W. H. Marmion for $1, 300. 00; Resolution 88-79 setting a public hearing for April 19, 1988, at 1: 15 p.m. to consider granting a ten foot (101 ) wide underground electrical distribution system easement at Klein Park to Gulf States Utility Company; and Resolution 88-80 authorizing approval exempting arson -investigation vehicles from state law provisions requiring identification of city and county vehicles in accordance with Article 6701m-2, V.T.C.S. for vehicles used for purpose of performing official arson investigation duties by the Beaumont Fire Department and authorizing Albert Haines, City Manager, George Schuldt, Chief of Police, Jack McCanne, Deputy Chief of Police, and Suzanne Brubaker, Purchasing Manager to submit applications for special license plates to the State Department of Highways and Public Transportation of behalf of the City. The Consent Agenda was approved on a motion made by Councilman Cokinos and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- A public hearing was called to consider an application filed by Ernest Lake of 2307 Avenue G, Nederland, Texas, who operates the Mid County Cab Company for a permit to operate a taxicab with the Beaumont city limits. Mr. Ernest Lake, operator of Mid County Cab Company, addressed Council to explain he wanted to obtain the permit to enable him to transport residents of Hughen School of Port Arthur to St. Elizabeth Hospital for therapy and return them to the school. -99- April 12, 1988 There being no one else to address Council, the public hearing was closed. Resolution No. 88-81 authorizing Ernest F. Lake a permit to operate a taxicab service within the corporate limits of Beaumont was approved on a motion made by Councilman Moore and seconded by Councilman Brumley. Question: Ayes: All Nayes: None -000- Resolution No. 88-82 authorizing purchase of a truck-mounted asphalt patching machine to be used by the Public Works Operations Division for patching potholes by a procedure designed for faster, less expensive and more durable repairs from H. D. Industries, Inc. in the amount of $56, 935. 00 was approved on a motion made by Councilman Lee and seconded by Councilman Brumley. Question: Ayes: All Nayes: None -000- Resolution No. 88-83 authorizing approval of a contract with Baytown Construction Company for construction of creative playground systems at Caldwood and Ida Reed Parks which include a base bid for grading, sidewalks and playground modules in the amount of $64,783 . 00, two shelters for $5,800.00, six picnic units at $400 each, and two drinking fountains at $1,000 each for a total bid of $74,983. 00 was approved on a motion made by Councilman Brumley and seconded by Councilman Lee. Question: Ayes: All Nayes: None -000- Resolution No. 88-84 authorizing approval of a $65, 000 loan to Bruce C. Irvine from the Historic Preservation Revolving Loan Fund to finance a rehabilitation project at 446 Orleans Street for a two-story building to be rehabilitated for office space for ten years at no interest was approved on a motion made by Councilman Lee and seconded by Councilman Brumley. Question: Ayes: All Nayes: None -000- A public hearing was called to consider ten (10) below-listed structures found to be in violation of the City of Beaumont' s Dangerous Structure Ordinance, Article III, Section 14-50: 3465-67 Grand - William J. Adams, owner (21 violations) , staff recommendation to raze or repair within 30 days; 3465-67 Grand (rear) - William J. Adams, owner ( 24 violations) , staff recommendation to raze within 30 days; 3845 Maida - Margaret Green, owner ( 18 violations) , staff recommendation to raze within 30 days; 4870 Avie - Dorothy S. Beckett c/o M. L. Lefler, owner (15 violations) , 5250 Sunset (Garage) - Sarah Biscamp, owner (5 violations) , staff recommendation to raze or -100- April 12, 1988 repair within 30 days; 345 Threadneedle - Larry Field, Jr. , owner (12 violations) , staff recommendation to raze or repair within 30 days; 1096 Colorado - Georgia King, owner (7 violations) , staff recommendation to raze or repaid within 30 days; 4090 Congress - Winifred Owens/Henry Grant, owners (8 violations) staff recommendation to raze or repair within 30 days; 2015 Joachimi - Herbert Johnson, Owner ( 17 violations) , staff recommendation to raze or repair within 30 days; and 1260 Harriot - Bobbie L. Crayton c/o Paul Brown, owner (7 violations) , staff recommendation to raze or repair within 30 days. Mr. William J. Adams, owner of the property at 3465-67 Grand, addressed Council regarding his need for acquiring a permit to rehabilitate the whole structure rather than a permit limited to $2,000 and requested more time than 30 days to finish rehabilitation. Mr. Adams was instructed to make an appointment with the Community Development Department to establish a viable work program. Sherrell Cockrell, Director of the Community Development Department, told Council that permits had been secured for rehabilitation of the structures located at 3465-67 Grand and 1260 Harriot. There being no one else to address Council, the public hearing was closed. A motion to accept Staff ' s recommendations for raze or repair was made by Councilman Cokinos and seconded by Councilman Smith. Question: Ayes: All Nayes: None Ordinance No. 88-34 declaring certain dilapidated structures to be public - nuisances and ordering their repair or removal by their owners and authorizing the Community Development Department to cause to be removed structures at 2405 Buchanan, 808 Buford, 1005 Doucette, 1728 Liberty, 2783-91 Liberty, 2783-91 Liberty (Garage) , and 3912 Park whose owners have failed to comply with previously issued condemnation orders was considered: ORDINANCE NO. 88-34 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDER- ING THEIR REPAIR OR DEMOLITION; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. Ordinance No. 88-34 was approved on a motion made by Councilman Lee and seconded by Councilman Brumley. Question: Ayes: All Nayes: None -000- Councilman Moore commented that "Sunday in the Park" events last week were very enjoyable and expressed appreciation to the forty Lamar students, a civic club, and the first and second graders from Blanchette and Price Elementary who helped clean Sprott Park. -101- April 12, 1988 Councilman Cokinos reported that the fund for the Hulsey children now totals $67,859. 00. The donation period is still open for contributors to participate. He also complimented the Region 5 Special Olympics and the organizers that was held at the Lamar University Ty Tyrrell Track. Councilman Lee announced that the first "Sunday in the Park" was very successful with about 2,000 people present. Next Sunday' s host will be the Southeast Texas Association for the Education of Young Children and Councilman Smith will be reading a story. Councilman Brumley commended Councilman Lee and the Clean Community Commission for a very successful "Can-Do Project" day cleaning various areas of the city and reported there was a lot of enthusiasm and a good turn out at Fair Park for the entertainment after the clean-up effort. Mayor Meyers referred to a letter received from Brandon and Matthew Hickey with a display of their artwork who were winners of the decorated trash can contest at the Clean Community Commissions ' s "Can-Do Day" project held on Saturday, April 9th. -000- Mr. Wayne Sherman, 325 Bradford Drive, addressed Council to report on the "Adopt-a-Cop" program to provide bullet-proof vests for Police officers. Donations can be sent to "Adopt-a-Cop" in care of First Interstate Bank, P. O. Box 3191, Beaumont, Texas 77704. Ms. Georgia Reagan, 1930 Franklin, addressed Council to suggest that citizen volunteers be used to relieve Police Officers in the Station and also ride as the second person in the vehicles to assist with routine matters.
