BE IT REMEMBERED that the City Council of the City of Beaumont, Texas met in regular session this the 23rd day of February, 1988, with the following present: HONORABLE: Maurice Meyers Mayor Bob Lee, Jr. Councilman-At-Large Andrew P. Haines City Manager Lane Nichols City Attorney Rosemarie Chiappetta City Clerk *Councilman Moore arrived at 1: 25 p.m. -000- The Invocation was given by the Reverend Renaud Stevens, pastor at Morningstar Missionary Baptist Church. The Pledge of Allegiance was led by Councilman Cokinos. -000- Two proclamations were issued: "National Engineers Week," February 22- 27, 1988 and "Family Entertainment Week, " February 22-29, 1988. -000- MAYOR MEYERS• We had, I think, a unique opportunity to see people who otherwise certainly would not have had the pleasure and fun they had this past Saturday when a group of people representing the Mayor' s Committee for the Employment of the Disabled put together a project called "Access to Rainbow. " And, I know as it was talked about prior to the activity, the looks that they got, and I know a couple of people I spoke to kind of really wondered if we had lost it when you would tell them that you were going to have 1,300 trout put into a wading pool so that people could fish! But, they did that, and they had handicapped and retarded people from around the area there from 9:00 until 3 :00 p.m. , Saturday, and I know those who were out there--the expression of pleasure that those participants had on their faces was indescribable, and, for many, it was an experience they never had before. It was for me! I 've never been able to catch a trout in a wading pool before! You just put a little -55- February 23, 1988 corn on the end of the hook, and it works real good. But, I 'd like to recognize, asking them, if they would, to stand--all the members, first, of the Committee for Employment of the Disabled and their chairman, Don Kelly. . .They went out and sought sponsors who gave assistance in varying forms, dollars and food, and, boy, there was plenty of food, I ' ll guarantee you, and it was good. I think Bill Munro fed the neighborhood, but everybody really did do their part, and I felt it was important when you have a community project as neat as that, and as much fun, I just want to read down the list. I know everyone' s not here, but I think everyone deserves a moment of recognition. Bill Munro from Munro' s Cleaners; Joe Tortorice from Jason' s Deli provided chips; Bill had the barbequed ribs and franks; Coca-Cola, Sue Mason; Baptist Hospital, Ann Blackburn provided billboards; George Wynne, portable billboard; Holland Advertising, Councilman Bob Lee provided the portable billboard space and had it brought over there--that means you have to stand, as well; and C & H Advertisement did the printing; C J' s Sporting Store, Clint Nichols, the fishing equipment; Caps 'n Things, the screens and discount; Bill Neild provided the tee-shirts; First Federal Savings and Loan, Jim Houston, also provided tee-shirts; Beaumont Trophy' s discounted the trophies. It was neat! If the trout had a pink ribbon on it, and they landed it--don' t ask me how they got ribbons on fish-- but if they caught one with a pink ribbon, then they received the trophy. KFDM, Channel 6, Jeff Pryor for his public service announcements; the Texas Parks and Wildlife, Bill Bowling, they provided the fish and brought it all in and emptied it in there at 7: 00 (a.m) , and I guess after 3:00 (p.m. ) , they cleaned it all out. And then there were many other volunteers who worked with the committee. But, on the behalf of Council and the citizens of the community, we just wanted to take a second and thank you. These are the kinds of activities that I think make a community a desirable place to live. MR. DON KELLY: Mayor, very briefly, we appreciate you and Councilman Brumley coming out and we appreciate your support of our work. This is the greatest group of volunteers I 've worked with. I 'd be remiss to say though that the Parks and Wildlife people--this is the 10th of 17 throughout the State of Texas--and they said they received more cooperation and greater warmth from any city that they've done thus far, and I wanted to personally go on record as thanking your Fire Department, which. . .had their EMS out there for the entire days, the Parks Department and the Recreation Department. It' s a fine facility out there, and we appreciate your support in our activities. Mayor Meyers recognized Margaret Harmon as the Staff person assisting in coordination of the activities and complimented her for a good job. -000- Mayor Meyers offered opportunity for citizens to comment on Agenda Items A or C. No citizens wished to address Council on these items. -000- -56- February 23, 1988 The following Consent Agenda items were considered: Approval of the Minutes of the Regular City Council Session held February 16, 1988; and Resolution 88-31 authorizing pledge of $500,000 in securities with the Federal Reserve Hank-Dallas/Houston Branch effective February 23 , 1988. The Consent Agenda was approved on a motion made by Councilman Cokinos and seconded by Councilman Lee. Question: Ayes: All Nayes: None -000- Ordinance 88-17 authorizing a specific use permit for an elevator sales, service and repair business at 1393 Broadway (requested by Tom Cobb, president of Allied Elevator, Inc. ) was considered: ORDINANCE NO. 88-17 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT TO ALLOW AN ELEVATOR SALES, SERVICE AND REPAIR COMPANY TO OPERATE ON PROPERTY LOCATED AT 1393 BROADWAY, BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance 88-17 was approved on a motion made by Councilman Cokinos and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Ordinance 88-18 changing the zoning from RS (Single Family Residential) to NC (Neighborhood Commercial) for construction of a Masonic Temple on a one-acre site extending from Avenue B to Avenue C on the north side of Harriot Street (requested by the Bishop Grant Masonic Lodge) was considered: ORDINANCE NO. 88-18 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING FROM RS (RESIDENTIAL SINGLE FAMILY DWELLING) TO NC (NEIGHBORHOOD COMMERCIAL DISTRICT) , ON PROPERTY LOCATED AT 3150 AVENUE B AT HARRIOT, BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. -57- February 23, 1988 Ordinance 88-18 was approved on a motion made by Councilman Samuel and seconded by Councilman Cokinos. Question: Ayes: Mayor Meyers Nayes: Councilman Councilman Lee Brumley Councilman Cokinos Councilman Smith Councilman Samuel Councilman Moore -000- An ordinance granting a specific use permit for a drinking establishment known as Hunters at 6025-A Phelan Boulevard (requested by Jeffery C. O'Quinn) that has been operating without a specific use permit was considered: ORDINANCE NO. ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR A DRINKING ESTABLISHMENT ON PROPERTY LOCATED AT 6025 "A" PHELAN BOULEVARD AT PEYTON AND CALDER, BEAUMONT, JEFFERSON COUNTY, TEXAS. The ordinance was denied on a motion made by Councilman Brumley and seconded by Councilman Lee. Question: Ayes: All Nayes: None -000- Ordinance 88-19 granting a specific use permit for a Masonic Temple to be erected on a one-acre site at 3150 Avenue B (requested by Attorney Kent W. Johns) to be used as a meeting hall, temple, office and community center was considered: ORDINANCE NO. 88-19 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT TO ALLOW A FRATERNAL ORGANIZATION TO CONSTRUCT A MASONIC TEMPLE OR LODGE ON PROPERTY LOCATED AT 3150 AVENUE B AT HARRIOT, BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance 88-19 was approved on a motion made by Councilman Samuel and seconded by Councilman Cokinos. Question: Ayes: All None -000- -58- February 23, 1988 Ordinance 88-20 granting a specific use permit to allow a duplex dwelling to be moved on a 0. 139 of an acre piece of property located at 790 East Irby Street (requested by William McCullough) was considered: ORDINANCE NO. 88-20 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR A TWO-FAMILY DWELLING ON PROPERTY LOCATED AT 790 E. IRBY AND UNIVERSITY DRIVE, BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance 88-20 was approved on a motion made by Councilman Brumley and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Ordinance 88-21 granting a specific use permit to allow a duplex dwelling to be moved on a 0. 112 of an acre piece of property located at 795 East Irby Street (requested by William McCullough) was considered: ORDINANCE NO. 88-21 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR A TWO-FAMILY DWELLING ON PROPERTY LOCATED AT 795 E. IRBY AND UNIVERSITY DRIVE, BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance 88-21 was approved on a motion made by Councilman Brumley and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Resolution 88-32 authorizing purchase of two tractors equipped with brush cutter from Oil City Tractors, Inc. at a total cost of $53,814 for use by the Operations Division of the Public Works Department was approved on a motion made by Councilman Lee and seconded by Councilman Brumley. Question: Ayes: All Nayes: None -000- Resolution 88-33 authorizing purchase of a motor grader from R. B. Everett & Co. at a total cost of $63,265 for use in the Public Works Operation Division for street construction and maintenance was approved on a motion made by Councilman Brumley and seconded by Councilman Lee. Question: Ayes: All Nayes: None -000- -59- February 23, 1988 Resolution 88-34 authorizing purchase of a 62-horsepower tractor-loader- backhoe combination from Equipment Headquarters, Inc. for use by the Water Distribution Division of the Water Utilities Department for a cost of of $27, 960 was approved on a motion made by Councilman Cokinos and seconded by Councilman Lee. Question: Ayes: All Nayes: None -000- Councilman Cokinos complimented the City, especially the Mayor, and City Manager for their leadership in making Summit II such an outstanding success and feels much enthusiasm has been generated. Councilman Lee also congratulated Mayor Meyers for the success of Summit II and thanked City Staff that was involved, the media, and citizens and stated that we should expect big dividends in the future from the endeavor. Councilman Brumley commended Mayor Meyers for his stick-to-it-ness in progressing with Summit II and for inviting such a dynamic and inspirational speaker as Mayor William Hudnut, III of Indianapolis. He said that when he left the meeting he felt he could "roll his sleeves up a little bit higher than what they have been in the past and be willing to get a little bit dirty now that we are down in the trenches of economic development. " He encouraged adults to support and encourage the youth in accomplishing the goals they have set. Councilman Smith extended her congratulations to Mayor Meyers and the City Staff for the organization of Summit II and thought the young people who participated were fantastic and expressed a desire to accomplish one-tenth of their predictions! Councilman Smith also expressed appreciation for the businesses that hosted the open houses for their sincere hospitality and for visiting V.I .P. ' s. Mr. Sam Mosely of HUD was with her at Southwestern Bell with a lot of information and workable ideas. In general, Summit II proved very productive. Councilman Samuel commended Mayor Meyers and the Staff for a great job of preparing Summit II and was happy to see the enthusiasm that was exemplified through people of all races and religions coming together to work for a common goal. Also, Councilman Samuel expressed his displeasure with a recent Beaumont Independent School District School Board Meeting that prohibited all citizens the opportunity of attending the meeting views because the meeting room was too small to accommodate the crowd and the unwillingness of the officials to relocate the meeting. He stressed the importance of human development as well as economic. Councilman Moore said he appreciated the enthusiasm and attendance of the young people at Summit II and hopefully, they will be able to bring about change to our community. He also supported Councilman Samuel' s displeasure with the Beaumont Independent School Board and stated his desire for better communication between leadership and citizens. -60- February 23 , 1988 Mayor Meyers expressed appreciation for efforts of Staff and thanked everyone who participated in producing a first-class event and stated that "we are in this for the long-haul. We, in this city, have a lot of work ahead of us, and we are just dipping into the water. It' s improving! Things across the board are improving, but. . .the race is just beginning, and there' s a lot to be done. " Mayor Meyers said we are at the "roll up the sleeves" stage, and we are ready to deal with anything and everything we have to. The process is a slow, keep working process that we are dedicated to--all of it. "Our work is just beginning. " He also thanked all of the media for their hard work and assistance. -000- Mr. C. L. Sherman, 585 Belvedere Drive, addressed Council regarding the success of Summit II, past Council meetings where garbage collection was discussed, his views regarding the tax structure in Beaumont compared to other Texas cities, and requested a line item budget. Mrs. Delia Harrington, 815 Willow, addressed Council to compliment Mayor Meyers and City Council for presenting Summit II and related the good comments she heard from others at Summit II regarding the quality and caliber of Beaumont' s Mayor and Council. Mr. Forrest "Ted" Posey addressed Council to compliment the Mayor and Planning Commission for Summit II and a scholarship fund for students. Mr. Henry Dannenbaum, 1567 Wall, addressed Council to express congratulations for Summit II and gratitude to Councilman Lee and Kirt Anderson of the Planning Department for their support of halfway houses. -000- There being no further business, the meeting was recessed - before continuing the City Council Workshop Session in the third floor conference room. -000- 2, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the minutes of the regular City Council session held February 23, 1988.
