BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 22nd day of April, 1986, with the following present: HONORABLE: Maurice Meyers Mayor Bob Lee, Jr. Councilman At Large Andrew P. Shelton Interim City Manager Lane Nichols City Attorney Myrtle Corgey City Clerk -000- The Invocation was given by Dr. Marshall Hayes, pastor of the Church of Jesus Christ of the Latter Day Saints. The Pledge of Allegiance was led by Councilman Samuel. -000- Several proclamations were issued: St. Elizabeth Hospital's "Volunteer Week in Beaumont" - April 20-26, 1986; "Clean Air Week in Beaumont" - April 23 - May 4, 1986; Beta Sigma Phi's "Founder's Day in Beaumont" - April 22, 1986. -000- The following Consent Agenda item was considered: The Minutes of the regular City Council session held April 15, 1986, were approved on a motion made by Councilman Brumley and seconded by Councilman Weisbach. Question: Ayes: All Tlayes: None -000- No one wished to address Council during the public comment portion on Agenda Items I through 8. -000- Ordinance No. 866038 authorizing execution of an agreement with Thomas Tew, Trustee for E.S.M. , was considered: -79- April 22, 1986 ORDINANCE NO. 86-38 ENTITLED AN ORDINANCE AUTHORIZING EXECUTION OF AN AGREEMENT WITH THOMAS TEW, TRUSTEE FOR E.S.M. GOVERNMENT SECURITIES, INC. AND PRO- VIDIING FOR THE LEVYING AND COLLECTING OF A SUFFICIENT TAX TO PAY THE INTEREST ON SUCH OBLIGATIONS INCURRED AND TO PROVIDE A SINKING FUND; AND PROVIDING FOR SEVERABILTY. The ordinance was approved on a motion made by Councilman Moore and seconded by Councilman Weisbach. Question: Ayes: All Nayes: None -000- Ordinance No. 86-39 directing the investment and pledge of funds received in the bankruptcy settlement of ESM Government Securities, Inc. was considered: ORDINANCE NO. 36-39 ENTITLED AN ORDINANCE DIRECTING THE USE AND INVESTMENT OF ALL FUNDS RECEIVED IN THE DISTRIBUTION OF THE BANKRUPTCY OF E.S.M. GOVERNMENT SECURITIES, INC. ; AND PROVIDING FOR SEVERABILITY. The ordinance was approved on a motion made by Councilman Lee and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Ordinance No. 86-40 amending Section 21-4 (overtime pay, compensatory time, stand-by pay and call out pay) of the Code of Ordinances relating to the Fair Labor Standards Act was considered: ORDINANCE NO. 86-40 ENTITLED AN ORDINANCE AMENDING CHAPTER 21 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT DEALING WITH THE PAYMENT OF OVER- TIME; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Brumley and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- -80- April 22, 1986 Resolution 86-138 authorizing purchase of a four-door sedan from Mingle Dodge in an amount of $10,260.68 for use by the Sanitation Department was approved on a motion made by Councilman Welsbach and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Resolution 86-139 authorizing purchase of two (2) electronic truck scales with computer from Beaumont Scale Company at an amount of $84,750.00 for installation and use at the Landfill site on Lafin Road was approved on a motion made by Councilman Brumley and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Resolution 86-140 amending the engineering services contract with Mark Whiteley to increase the design phase of the St. Elizabeth/Gaylynn and IH-10/11th Street Drainage Project by adding ' $12,440, making the total contract not-to-exceed amount $42,519 was approved on a motion made by Councilman Cokinos and seconded by Councilman Moore. Question: Ayes: All Mayes: None -000- Resolution 86-141 accepting the 1984 Community Development Block Grant Sidewalk Program as complete (Fourth Street - east side from Washington Boulevard to West Virginia and Hale - north side from Magnolia to Pine Street; final total contract $115,623.30) and authorizing final payment of $6,797. 10 to Greer Construction was approved on a motion made by Councilman Weisbach and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Resolution 86-142 authorizing Change Order No. 1 to the contract for sanitary sewer improvements with Excavators and Constructors, Inc. for adjustment for actual as-built quantities, extra items of necessary work by reducing the amount of $17,700.70 (total revised contract $719,842.63) and authorizing final payment of $36,202.54, was approved on a motion made by Councilman Lee and seconded by Councilman Samuel. Question: Ayes: All Nayes: None -000- The City of Beaumont fiscal year 1985 financial audit was presented by Sheila Clark, managing partner of Peat, Marwick, Mitchell and Company. -000- Mrs. Delia Harrington, 315 Willow, addressed Council in appreciation of the Seisquicentennial Celebration held at Riverfront Park Monday, April 21st and to invite all to the "Welcome to Beaumont" Park opened Saturday, April 19th. -81- April 22, 1986 Mayor Meyers invited all citizens to the reception honoring Fire Chief, C. A. "Pete" Shelton, Interim City Manager, to be held in the Civic Center, Monday, April 28, 1986, 6:00 to 8:00 P.M. -000- Mrs. Mabel Thibodeaux, 1107 Harrison, owner of a structure located at 3750 Fannett, requested correction of a sidewalk at the 3750 Fannett location and shared driveway at 1107 Harrison. Mrs. Alice Brown, 2265 Jacob, addressed Council to complain of poor drainage in her area. -000- There being no further business, the session was recessed before continuing with the City Council Workshop Session.
