BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 3rd day of October, 1987, with the following present: HONORABLE: Maurice Meyers Mayor Bob Lee, Jr. Councilman At Large Andrew P. Cokinos Councilman At Large Lulu L. Smith Councilman, Ward I Mike Brumley Councilman, Ward II Audwin Samuel Councilman, Ward III David W. Moore Councilman, Ward IV Betty Dunkerlby Acting City Manager Lane Nichols City Attorney Rosemarie Chiappetta City Clerk -000- Councilman Lulu Smith greeted and welcomed Dr. Don Claybrook back to' Beaumont. The Invocation was given by Dr. Claybrook of South Park Baptist Church. The Pledge of Allegiance was led by Councilman Smith. -000- Mayor Meyers read a release that stated since the public has been so responsive to touring the tall ship Elissa, the vessel will remain narked at -,RiverfxoiiL Park an additional day, through November. 5 11,87. Tours will be available 8 : 00 a.m. to 8:00 p.m. , November 4 and 5, 1987. Approximately 9, 000 people toured the Elissa by Monday evening. Also, Mayor Meyers invited everyone to participate in a rate opportunity tomorrow morning at 7: 00 a.m. in the filming of a special tape at the Elissa to be previewed November 24th at 7: 30 a.m. on A.B.C. ' s Good Morning America Show. The taping will allow Southeast Texas to wish viewers of Good Morning America a Happy Thanksgiving. -000- Five proclamations were issued: "National Diabetes Awareness Week, " November 2-8, 1987; "Chemistry Day, " November 6 , 1987; Viet Nam Veterans Chapter 292: "Parade of Thanks Day, " November 7, 1987; the "Morehouse College Glee Club" hosted by "Southeast Texas Black Heritage Society" premiering November 7, 1987 at 8:00 p.m. ; and "Key Club Week, " November 1-7, 1987. -000- -378- November 3 , 1987 Mayor Meyers announced that since there is no Work Session today, an Executive Session will be called at the close of the Regular City Council Session, pursuant to Section IIe of the Texas Open Meetings Act to discuss pending or contemplative litigation. -000- Mayor Meyers invited citizens to comment on Agenda Items A, C, or D. No citizens wished to address Council. -000- The following Consent Agenda items were considered: Approval of the Minutes of the Regular City Council Session held October 27, 1987 and the Minutes of the Special City Council Session held October 28, 1987; and Resolution 87-223 authorizing a refund of overpayment of 1985 city taxes on property at 5850 Calder (paid twice) in the amount of $5, 613 . 50 by Home Savings of America; The Consent Agenda was approved on a motion made by Councilman Cokinos and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- An ordinance granting a specific use permit for a wastepaper and recycling plant (postponed from the October 27th meeting) at 3540-50 South Eleventh Street with stipulations that no machinery be operated after 7:00 p.m. , storage materials no higher than an eight-foot fence, the noise , level .,not allowed to exceed 65 db, -no vehicular access,, from Westmoreland and Anita, a landscaped buffer zone, with an eight-foot solid wood fence, be maintained on the north, west and south sides of the property was considered: AN ORDINANCE ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR A WASTEPAPER AND RECYCLING PLANT ON PROPERTY LOCATED AT 3540-50 S. ELEVENTH STREET, BEAUMONT, JEFFERSON COUNTY, TEXAS. Mayor Meyers gave Acting City Manager Betty Dunkerley a citizens , petition for a matter of record and mentioned numerous telephone calls regarding the permit. After a discussion, Councilman Moore made a motion seconded by Councilman Smith to delay action on this item until the next regularly scheduled City Council meeting. Question: Ayes: All Nayes: None -379- November 3 , 1987 In addition, Councilmembers directed questions to Acting Planning Director Kirt Anderson regarding the noise level created by this operation, possible unpleasant odors, storage regulation, infestation of rodents or other pests, exact location and cover of bailer in a pit, and increased and heavy traffic that could deteriorate streets or create an unsafe situation. Councilman Moore requested that a report relative to these queries and any additional information that might be available be given to Council by Friday, November 6th. Councilman Lee asked that in the ordinance the language be more specific regarding the pit bailer being totally enclosed within a building, not just with an overhang. -000- Resolution 87-224 authorizing purchasing of a year' s requirement of traffic marking materials at an estimated total expenditure of $81, 874 . 85 with: D & Sign & Supply Co. , of Beaumont, approximately 1,000 sign posts, $12. 47 each, estimated total of $12,470; Trantex Trans- portation Products of Texas, Inc. , Houston, approximately 4,000 3/4 inch white ceramic markers at $ . 44 each and approximately 4,000 3/4 inch yellow ceramic markers at $ . 44 each, for an estimated total of $4,269; Pinkley Sales Co. of Oklahoma City, approximately 1 , 000 gallons of yellow and white traffic paint at $6. 25 per gallon, for an estimated total of $6 , 250; Southwestern Materials of Austin, approximately 5,000 pounds of bituman adhesive at $1. 26 per pound, approximately 4,000 two- way yellow Stimsonite Lite Reflectors at $1 . 41 each and approximately 4, 000 one-way white Stimsonite Lite Reflectors at $1. 29 each for an estimated $12 ,100 ; Cataphote Division of Ferro Corporation of Jackson, Mississippi, approximately 6,000 feet of 411 , 811 , 12" , and 24" pavement marking tape for an estimated $9, 320; Vulcan Signs of Foley, Alabama, approximately - 2,800 anodized aluminum sign blanks in various sizes, for an estimated $14,681 . 50; and Mid-Ohio Markings and Traffic Signs, Inc. , Norwalk, Ohio, approximately 74 fifty-yard rolls of reflective and non- reflective sheeting in various widths, for an estimated $14,724 and approximately 1 , 655 sign faces of various kinds for an estimated $8 ,060 was approved on a motion made by Councilman Samuel and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Resolution 87-225 authorizing an intergovernmental agreement with the South East Texas Regional Planning Commission for a Section 8 transit planning grant in the amount of $30,000 for fiscal year 1988 was approved on a motion made by Councilman Moore and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Mayor Meyers recognized Mr. John Simonetti, District Manager for Entex, and thanked him for Entex' continued contribution in civic projects and invited their employees to join in the filming tomorrow morning for the Good Morning America wish from the Elissa. -380- November 3 , 1987 Councilman Lee also thanked Mr. Simonetti for his help with the Elissa project, especially in providing school age children the opportunity of touring the ship and invited everyone to attend "Sunday in the Park" next week that will be hosted by the Golden Circle Rebecca Lodge. Councilman Brumley stated that Entex started the momentum that caused other companies to become involved in community affairs such as the Elissa project and thanked David Ashcraft, Vice President of Temple Eastex for their participation and contribution to the Elissa endeavor. Councilman Cokinos expressed that the participation in the Elissa venture has created a sense of pride and belonging to Beaumont that has gone beyond our own city limits to Lumberton, Silsbee, Buna, Kirbyville, and surrounding areas. Councilman Moore said this has not only been a good weekend, but a good month filled with exciting activities. He requested that Staff check into the situation at Avenue A and Florida where tree limbs are hanging into the street and could cause problems, asked Environmental Health to check a potential health hazard on Dauphine Place where trees have grown up around a swamp hole, and invited everyone to attend the Neighborhood Meeting in Ward IV tonight at the Melton YMCA to discuss issues that citizens might wish to present in order to receive input to work on a progress report before the Town Meeting in Ward IV. Mayor Meyers asked that as the exchange of ideas take place in tonight' s meeting that Councilman Moore challenge the citizens to volunteers to get involved in our city. Councilman Samuel assessed the past week as very special and the excitement exhibited a true change of attitude; "we're Beaumont proud and. . .this is very contagious; and the more we present this feeling of being Beaumont proud, the more it -will spread: Councilman Smith enjoyed the delightful weekend and congratulated Councilmen Lee and Brumley for their effort with the activities of the Elissa. -000- Henry Dannenbaum, 3305 Avenue A, addressed Council to thank the Mayor and Council for bringing the Elissa to Beaumont and giving children the educational opportunity to tour the ship. -000- There being no further business, the meeting was adjourned to convene the Executive Session. -000- I, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the regular City Council session held November 3 , 1987.
