BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 15th day of September, 1987, with the following present: HONORABLE: Mike Brumley Mayor Pro Tem Bob Lee, Jr. Councilman At Large Andrew P. Cokinos Councilman At Large Lulu L. Smith Councilman, Ward I Audwin Samuel Councilman, Ward III David Moore Councilman, Ward IV Absent: Maurice Meyers Mayor Albert E. Baines City Manager Lane Nichols City Attorney Rosemarie Chiappe tta City Clerk -000- The Invocation was given by the Reverend George Kappaz, pastor of Parkdale Assembly of God church. The Pledge of Allegiance was led by Mayor Pro Tem Brumley. -000- Three proclamations were issued: "Safety Council of Southeast Texas Bike Safety Week," September 13-19, 1987; "P.O.W. /M.I.A. Recognition Day," September 18, 1987; and "American heart's Food Festival Week," September 13-19, 1987. The P.O.W./M.I.A. flag will be flown at City Hall, Friday, September 18, 1987, and everyone is invited to a Candlelight Vigil at Riverfront Park beginning at 6:00 p.m. to offer prayer for the release of the prisoners of war missing in anion. -000- Mayor Pro Tem Brumley acknowledged Councilman Moore's birthday and All in attendance extended best wishes. -000- Mayor Pro Tem Brumley announced that Mayor Meyers is in Israel with the 8th Jerusalem Conference of Mayors speaking on revitalization of cities. -000- Mr. Robert Alspaugh and Mr. Scot Latinis representing Clear Sky Sport Parachute Center located at the Beaumont Municipal Airport were introduced. They presented Mayor Pro Tem Brumley with a First-Jump Certificate which he earned as part of the Tandem Jumping Program at the Airport Appreciation Day celebration, September 12th. -000- -327- September 15, 1987 Ms. Kathy Clark, Mr. John French, Ms. Joanne Polk, and Ms. Corny Heartfield were introduced as members of the Beaumont Symphony. They announced their 35th season will begin September 16th and as part of the Sesquicentennial celebration, the Beaumont Symphony Society is presenting to the citizens of Beaumont a free children's symphony October 4, 1987, at 4:00 p.m. in the Julie Rogers Theater entitled "Color Me Music," performed by the Chamber Ensemble. -000- Mayor Pro Tem Brumley called an Executive Session following Work Session, pursuant to Section IIe of the Texas Open Meetings Act, to discuss pending litigation. -000- No one wished to address Council concerning Agenda Items A through E. -000- The following Consent Agenda Items were considered: Approval of the Minutes of the regular City Council session held September 8, 1987; Resolution 87-186 appointing Ben F. Hughes to the Sr. Citizens Advisory Commission for a term expiring September 30, 1990; John Huffman to the Airport Advisory Commission for a term expiring May 31, 1989; and Dolly Johnson to the Parks and Recreation Advisory Commission for a term expiring June 30, 1989. The Consent Agenda was approved on a motion made by Councilman Samuel and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Resolutior_ 117--187,authorizing an intergovernmental cooperation agrezm nt with Jefferson County to furnish labor and equipment for maintenance, repair and reconstruction of City streets, road ditches and recreational areas in coordination with other County work, And in exchange the City of Beaumont provide back-up fire protection for the Jefferson County Airport during emergencies was approved on a motion made by Councilman Lee and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- City Council was interrupted by . representatives of the Beaumont Sesquicentennial Kangaroo Court to serve City Council members, the City Manager, City Attorney and visiting Jefferson County Tax Assessor/Collector Nick Lampson subpoenas requiring their presence at Kangaroo Court, Sunday, September 20, 1987, at Riverfront Park to answer charges for not wearing proper Sesquicentennial attire (beards, ribbons, etc. ). -000- -328- September 15, 1987 CORRECTION After Councilman Cokinos raising a question concerning the percentage cost (7%) for the City of Beaumont, Resolution 87-188 accepting the work performed by Arlesco, Inc. for construction of transit route benches and shelters, authorizing Change Order No. 2 adding $3,061.76 to reflect actual quantity of materials used, and authorizing final payment in the amount of $865.41 was approved on a motion made by Councilman Cokinos and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Resolution 87-189 accepting the work performed by E. R. DuPuis Concrete Co. for transit maintenance facility parking lot improvements, authorizing Change Order No. 2 adding $621. 75 to reflect actual quantity of materials used, and authorizing final payment in the amount of $3 ,205.75 and amended to denote the 7% total participation cost to the City was approved on a motion made by Councilman Cokinos and seconded by Councilman Lee. Question: Ayes: All Napes: None -000- Resolution 87-191 scheduling a public hearing on September 22, 1987 at 1 :15 p.m. at City Council Chambers relating to proposed amendments to the proposed budget for Fiscal Year 1987-88 was approved on a motion made by Councilman Samuel and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Resolution 87-192 authorizing execution of a local health services contract with the Texas Department of Health to provide funds for a nurses-s position, personnel community and rural health services, and maternal and child health services was approved on a motion made by Councilman Lee and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Councilman Moore requested that the railroad company be contacted about needed repairs to the tracks where Lavaca and Sarah Street split; related he has received a call from a citizen concerning proposed street repairs going west on Iowa Street and requested consideration be given to the eastly direction; asked Torn Warner for an update on Downs Road near Tyrrell Park stating it was in poor condition; and asked if we are still practicing the policy of rehiring previously laid-off personnel for vacancies. Mr. Haines affirmed we are still using the same hiring practices. -000- Councilman Cokinos reported that .he . has also received a call about street repair on Iowa from Highland Avenue to Port Arthur Road and Iowa to Lavaca starting at Maddox and requested Mr. Webb to check if there is an active water line on the back side of Tyrell Park that can be used for beautification purposes. -000- Councilman Lee announced that "Sunday in the Park" for September 20th will be hosted by Fashion Showcase, and that Councilman Moore will be reading the comics; and that on September 24th he and Councilman Cokinos will host "Concert on the Move" at Tyrrell Park and that more information will follow. Councilman Smith reminded everyone that the new Art Museum is now open and is a tribute to our community and encouraged attendance. Mayor Pro Tem Brumley reported that Family Fun Day at the Beaumont State Center was very successful and a day of fun. -000- -330- September 15, 1987 Mr. Henry Dannenbaum, 3305 Avenue A, addressed Council regarding group homes, wished Councilman Moore happy Birthday, an ordinance controlling beer sales on Sunday, and imposing a curfew. Mrs. Diana Copeland, 1652 Avenue I, addressed Council regarding unusual flooding problems on Avenue I between Foch and Corley and requested drainage assistance. Councilman Moore asked Mrs. Copeland to confer with Tom Warner, the Public Works Director. Mr. Roy Gorman, 2332 Wilson, addressed Council regarding a prostitute on "The Strip" (Neches, Langham, Royal, and Park) diagnosed as having AIDS and infecting the community through her trade, the various tests involved in diagnosing AIDS, and imposing a loitering law. Councilman Smith commented there is a lot of hysteria in the community caused by not undertstanding the problem, that the community needs to be educated regarding the disease, and that AIDS cannot be contacted by casual contact. Mr. Nick Lampson, Tax Assessor/Collector for Jefferson County, addressed Council regarding clarification of scheduling of adoption of the tax rate. Mr. Haines stated that the budget and tax rate will both be adopted September 22, 1987. Mr. Ric Warchol, 1155 IH 10 South, addressed City Council regarding privatization of residential sanitation services and requested releases of liability for the S.W.A.T. Team personnel to practice on the La Salle Motel. -000- There being no further business, the meeting was recessed before continuing with the City Council Workshop Session for review of the Municipal Airport Master Plan Update and continued discussion of the 1987-88 Budget (Convention 5 Visitor's Bureau and the Water Department). -000- I, Rosemarie *Chiappe tta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the regular City Council session held September 15, 1987.
