BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 26th day of May, 1987, with the following present: HONORABLE: Maurice Meyers Mayor Bob Lee, Jr. Councilman At Large Andrew P. Haines City Manager Tyrone Cooper Assistant City Attorney -000- The Invocation was given by the Reverend Lonnie Treadway, pastor of New Life Tabernacle Church. The Pledge of Allegiance was led by Councilman Moore. -000- Fifth grade students from Martin Elementary School were welcomed to today's session and invited to the Council table to personally greet each member of Council. Their teachers stood for recognition. -000- Councilman Lee introduced Mrs. Jacqueline Walters Andres, representing the Young Homemakers of Texas, saying that her group had agreed to join the Clean Street Program by contracting for the mowing, edging of the curb and pick-up of litter on Liberty Street between Center and Magnolia Streets. -000- MAYOR PRO TEM MIKE BRUMLEY: Beaumont has a reputation of having the groups of champions - we always have had in the past. That's one of the first things I remember about ever hearing the word Beaumont was through football teams that were coming out of here. And, we had an opportunity through the school district, but we have just as famous private school programs with Kelly winning the State Football Championship but we've got a group of celebrities and true . . . They meet the true definition of champions because these are the 1987 Baseball State Champions in Division II, Texas Association of Private Schools and we are honored to have, not only the champions, but they are the ambassadors and they represented and they've brought the word of Beaumont, Texas, to every private school across the State of Texas and they are our citizens. -200- May 26, 1987 COUNCILMAN BRUMLEY continued: They are the leaders in our community. We've got them here today because they are the ones that need to be honored. We've got the 1987 Beaumont Christian High School Baseball Team and they are the State Champions. And, not only do we have the whole team here, we've got some special people that are on the team that made All-State. The first person that I'd like to introduce is Mr. Tommie W. Sides. Tommie is the Coach and I'll let you recognize the rest of pour coac. es ut want to take the opportunity and the honor to recognize the team, if I might, the ones that are here. Robert Duren . . . Chad Clothier, Michael Richards, Chad Frazier, Toby McKinstry, James Grif f in, Pete E ott. nw-iee are our ottFer people that are here and these, along with their teammates and their help, I am sure, made All-State Baseball Team for Private Schools - Brian Burks, Chris Smith, Darrell Richmond and Marcus King. And, Coach, on behal o the Council a-nd-t of_ a on e a f of the ty o eaumont, we want to congratulate you on what you have done this past year. I started reading about the team as they got into the Regionals. To let you to know they are no slouches with a bad season. They didn't win by short margins as far as runs. They won the regionals in Houston. They beat St. John's of Ennis, Texas, 9 to 3; then they went to the State Semi- finals and they beat this is probably one of their better games. They beat Temple Christian from Dallas 9 to 8. I guess t'a'll enjoyed that game, didn't you? Then, they won the State Championship by beating Northland Christian from Houston, Texas, 11 to 7. And I'll go ahead and introduce then for you, Coach. Mike Simms is the Assistant Coach and Doug Boyd is an Assistant Coach (president of the Booster Club and volunteer assistant coach). Doug, two slots, two Positions now, huh? (Beaumont Police Department Patrolman Doug Boyd). That's good. Ya'll didn't have any trouble on the road, did you? Good. We can't tell you how much . . how proud we are of you. The success that you brought the school, the recognition you've brought the school, but most of all the recognition you've brought to all the citizens of Beaumont. COACH TOM SIDES: First of all, I'd like to thank Mayor Meyers for inviting us down here and the secretary for arranging things, Barbara Boudreaux. We feel very honored that the City wants to honor us like this. My team, as you can see, we are a small team and everyone of the boys contributed'- in their way by winning the State and as most Of t'a'll know, w`en you have a State Championship Team, it sort of brings the school together, the kids together and the City together. And, I'd like to thank everybody for recognizing us. We do need to get back to school. MAYOR MEYERS: I think tonight is your graduation, is that correct? Haw r,anv of you are seniors? (.T wo) okay, well, you ought to do all right. well , we'll see you tonight. I believe 1"n going to spend a few mo-nents with you at graduation tonight and again, congratulations to all of you from Council and from the citizens. We appreciate the efforts. Thank you very much. -201- "'.ay 26, 1987 Several proclamations were issued: "Salute the Hospitalized Veterans Days" - May 29 and 30, 1987; "Women Entrepreneurs, Partners with Business and Industry Day" - May 27, 1987; a proclamation recognizing Dr. Harvey Jo nson as t e an a the Year by members of (quoting Mr. George Hudspeth "Seniguar's Convenience Center (holding company) with two subsidiaries: Seniguar Coffee Club ('where we discuss the great issues of the day') and SSI ('Seniguar's Syndicated, Inc. where we do the political polls and analysis of the elections once they've come in, -very much like Mr. Sanders out here at Lamar University. The only difference is that we don't get paid for it'); and a proclamation for "Safe Boating Week in Beaumont" June 7 - 13, 1987. -000- Public comment was called on Agenda Items A through E. No one wished to address Council concerning these items. -000- The following Consent Agenda item was considered: Resolution 87-105 authorizing the purchase of two (2) 9335-B01 direct access diski storage devices from IBM, the sole source supplier, for use in the M. I.S. Division at a cost of $32,300 for the City's data processing system. The Consent Agenda was approved on a Motion made by Councilman Moore and seconded by Councilman Brumley. Bailey for development of an office park on a 1.3 acre tract - to construct 4 new single-story office buildings and future remodeling of an existing residence into an office building) was considered: ORDINANCE NO. 87-36 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING FROM RS (RESIDENTIAL SINGLE FAMILY DISTRICT) TO RM-H (RESIDENTIAL MULTIPLE FAMILY-HIGHEST DENSITY DIS'T'RICT) ON PROPERTY LOCATED AT 5820 CALDER AVENUE AND BELVEDERE ON PROPERTY DESCRIBED AS TRACT 35, PLAT D-26, H. WILLIAMS SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS. The ordinance was approved on a motion made by Councilman Cokinos and seconded by Councilman Lee. Question: Aves: All Nayes: None -000- Ordinance No. 87-38 granting a Specific Use Permit for a package liquor store at 1305 Franklin Street (requested by Can Van Nguyen, owner of T & T Liquors, to move from its present location at 1337 Franklin to a location next door in the Viet Nam Market/Oriental Center at the intersection of Franklin and Orange ) was considered: ORDINANCE NO. 87-38 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR A PACKAGE LIQUOR STORE ON PROPERTY LOCATED AT 1305 FRANKLIN AND DESCRIBED AS LOTS 133, 134 AND 135, BLOCK 12, CRARY ADDITION, BEAUMONT, JEFFERSON COUNTY, TEXAS. Question: Ayes: All Napes: None -000- An ordinance changing the zoning from RM-H (Residential Multiple Family Dwelling - Highest Density) to LI (Light Industrial) for property on the northeast side of Orange Avenue at the Gilbert Street intersection, described as the north 45 feet of Lot 68, Lots 61 and 62, Block 6, and Lots 58, 59 and 60 and Lots 52, 53 and 54, Block 5, Crary Addition (requested by Stephen R. City staff recommended denial of the request: zone change does not comply with the Comprehensive Plan; Industrial Zoning would allow the development of incompatible commercial and industrial uses with adjacent residential uses; zone change would create an undesirable transition of zoning districts along front property line on Orange Street and along south side property line of Lot 67, Block 6; the existing streets are not built to industrial standards and are inadequate for commercial or industrial truck traffic; and requested rezoning would create non-conforming lots which would not meet the zoning ordinance requirements for area and width. Councilman Lee made a motion to deny the ordinance; motion was seconded by Councilman Samuel. Question: Ayes: All Nayes: None Ordinance No. 87-40 changing the zoning on the west 80 feet of Lots 52, 53 and 54, &EK 5 Crary Addition, correcting the original zoning of the property (under one ownership with two different zonings - LI and RM-H) was considered: ORDINANCE NO. 87-40 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING FROM RM-H (RESIDENTIAL MULTIPLE FAMILY DWELLING- HIGHEST DENSITY DISTRICT) TO LI (LIGHT INDUSTRIAL DISTRICT) ON PROPERTY DESCRIBED AS THE WEST 80' OF LOTS 52, 53 AND 54, ^LOCK 5, CRARY ADDITION, BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. -204- May 26, 1987 Ordinance No. 87-40 was aproved on a motion made by Councilman Lee and seconded by Councilman Brumley. Question: Ayes: All Nayes: None -00a- Ordinance No. 87-41 amending the Electrical Code was considered: ORDINANCE NO. 87-41 ENTITLED AN ORDINANCE AMENDING CHAPTER 6, ARTICLE IV, THE ELECTRICAL CODE, OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. The ordinance was approved on a motion made by Councilman Brumley and seconded by Councilman Samuel. Question: Ayes: All Nayes: None -000- Resolution 87-106 authorizing Change Order No. 2, adding $6,400 to the contract with Bo-Mac Contractors, Inc. (contract to $68,648.00) for the construction of Phase I of the Marina Expansion Project (change order provides for design change from 64 connecting columns for roof supports in Phase II and substitutes 64 additional pilings in Phase I to be driven at $100.00 each - City to purchase at cost of $4,986.24 -- change means $221400 reduction in Phase II by elimination of 64 columnn connections, leaving a net savings of $11,013.76 for Phase I and II) was approved on a motion made by Councilman Lee and seconded by Councilman Brumley. DuPuis Concrete Company, Inc. , at a cost of $45,438. 48 fur construction of the Transit Maintenance Facility Parking Lot Improvement Project (Urban Mass Transportation Administration fund 80%, State fund 13% and City's share at 7%) was approved on a motion made by Councilman Cokinos and seconded by Councilman Samuel. Public Health Service under the Coraunmity Health Center Grant Program for expansion of the Beaumont Community Health Clinic services was approved on a motion made by Councilman wore and seconded by Councilman Samuel. Question: Aves: Mayor Meyers Nayes: CounclRan Smith Councilman Lee Councilman Cokinos Councilman Smith Councilman Brumley Councilman Samuel Councilman Moore -205- May 26, 1987 Resolution 87-109 authorizing the purchase of a 14,000-pound wheel-type loader with backhoe at $24,318. 18 and a 14,000-pound wheel-type loader with backhoe and closed canopy at $26, 286.66 from Preco Machinery Sales, Inc. of Beaumont and a 15,000-pound wheel-type loader with backhoe and 30-inch bucket from Equipment Headquarters, Inc. of Beaumont, at $41 ,425.00 for the Operations Division of Public Works (new equipment to replace three five-to-nine-year-old loaders to be retired and sold in the City's August 1st Auction for sale of surplus property) was approved on a motion rude by Councilman Brumley and seconded by Councilman Lee. Question: Ayes: All N ayes: None -000- MAYOR EYERS: I would just take opportunity to mention that some time ago, you-11 . . . Council will recall that due to the efforts of Mr. Walter Mayer. , a member of our Planning Commission and an avid pilot, we were able to make a request to receive in our City an outstanding Viet Nam Fighter Aircraft, referred to as the "Voo Doo" and everybody remembers that. The Voo Doo is on its way and will be here probably tomorrow night or Thursday. And, we've received some cooperation from Mr. Will Ohmstede of Ohmstede Machine and the 20 x 60 (foot) breakdown storage space he'll be permitting us to house that there until we can find a suitable place for display and the project itself. Walter's here. And, Walter, any :­omments that you grant to make while you are here? I would hope that the media x:11 recognize your efforts as well and I believe this will truly turn to be a very significant replica for our City. MR. WALTER MAYER: Mayor and Council, I thank you for your support. This seems like it took a long time. I think we've been working on it for a year and the contractor that`s bringing the aircraft down from Shepherd Air Force Base called me last night and he's effectively . . . He's loaded the aircraft on two trailers and today he was going over to the Highway Department to get his various permits so depending on . . . if he successfully gets his permits from the Highway Department in time to drive the two semi-trailers and tractors from Wichita Falls to Beaumont, the aircraft should be here tomorrow - probably late in the day or first thing Thursday and I think it is a very exciting project. When completed and the airplane is placed on its pedestal appropriately, it will be sor,-�ething that the entire community with your leadership can justly be proud of. MAYOR :MEYER.S: Thank you very much, Walter. We appreciate it. I know you will get with Betty on getting some of the money you raised so that he can be paid. Walter took it on his own to steerhead a volunteer fund raising effort to secure necessary funds so this again: is a total volunteer project void of any City money but one that I think will ultimately prove to be very worthy for our commiunity. -206- May 26, 1987 Councilman Lee mentioned that "Sunday in the Park" activities will be hosted by KFDM in Riverfront Park, May 31st. Councilman Moore invited all to the Community Breakfast to be held Saturday, May 30th, at 8.30 a.m. , with Councilman Brooks as speaker. -000- Mrs. Maree Calcote, Chairman of the Clean Community Commission, addressed Council to invite all to join the Clean Community Commission on Thursday morning at 7:15 a.m. to honor the Sanitation Division of the City by serving coffee and doughnuts and saying "Thank You" to the employees of that division. Mr. Steve Ingraham, president of ICORP, Inc. , addressed Council to express his "thanks for all the many people who did so much on our behalf in trying to have our business expand and grow in Beaumont.
