BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 19th day of May, 1987, with the following present: HONORABLE: Maurice Meyers Mayor Bob Lee, Jr. Councilman At Large Andrew P. Cokinos Councilman At Large Lulu L. Smith Councilman, Ward I Mike Brumley Councilman, Ward II Audwin Samuel Councilman, Ward III David W. Moore Councilman, Ward IV Albert E. Haines City Manager Tyrone Cooper Asst. City Attorney -000- The Invocation was given by the Reverend Durwood Bristow, pastor of Forest Park United Methodist Church. The Pledge of Allegiance was led by Councilman Cokinos. -000- Two proclamations were issued: "National Association of Insurance Women's Week" - May 17-23, 1987 with "Awareness Day" - May 19, 1987 and "Texas Buckle Up Week in Beaumont" - May 18-25, 1987. -000- MAYOR MEYERS: Dan (Mabry), nice to see you. Dan is here today and we are going to have opportunity to Dan share with us some of the activities of the West End Y's Swim Team. Won't you come forward and bring your crew with you? MR. DAN MABRY: . . . Behind me are . . . MAYOR MEYERS: Bring them up here - let everybody get a good look at them. -195- May 19, 1987 MR. MABRY: These are a few members of the West End YMCA Swim Team. We have ages 6 through 18 represented on the team. As you can tell, the younger ones are here. The older ones, most of whom are busy with their finals in school and could not join us today. If I may, I'd like to call their names out - Brian Dittman and Andy Olson and Tracy Mabry and Amanda Smith and Loren Dittman and McGee Olson and the older one that could make it is Lisa Gosch and she is also coaching our summer league team. . . . These kids practice year round. Swimming is not a summer or a seasonal event. They practice year-round at this sport and they represent Beaumont and the West End Y at swim meets around Texas and Louisiana. They, along with the rest of our community . . . We are proud of our community. We are proud of who we are and what we represent and we'd like to make that known everywhere we go. The West End Y is also instrumentally each summer in organizing the Golden Triangle Swim Association which is a summer league swim organization which holds meets with teams in this area during the months of June and July. Our purpose of the swim team and of the Golden Triangle Swim Association is to promote fun, teamwork and self-discipline through a structured activity and especially in the summer time. This Saturday at the West End YMCA at 9:30 (a.m. ) we are hosting a swim meet and this will be a year-round swim meet where we will be bringing in teams from Texas, you know, Houston and Louisiana area, primarily. We would like to invite everyone to come out to this meet and help support Beaumont and help support the team and come see what it is like and we would also like to invite everyone who has children or grandchildren to explore the possibility of them joining one of the teams in the Golden Triangle Swim Association. And, I would like to close with a thank you for allowing us to come and be here today and we also have T-shirts that aren't here yet but we have one for each one of you on the Council and if you will come here Saturday, out to the West End Y at 9:30, I promise we will have them then. My name is McGee Olson and I like Breast. My name is Tracy Mabcy and I like Butterfly. MAYOR MEYERS: Well, we thank you all for coming. Good luck this Saturday. -000- The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council session held May 12, 1987 and the corrected Minutes of the regular City Council session held February 28, 1987; Resolution 87-100 authorizing the release of $930,000 in securities held as collateral for City deposits by Texas Commerce Bank, Beaumont; -196- May 19, 1987 Resolution 87-101 waiving penalty and interest charges on tax payments made in January, 1987, and not credited to Account 300056-027900 in the name of Peter Lightfoot and Account 046650-030500 in the name of Eddie McGriff; and Resolution 87-102 authorizing execution of an agreement with Larry Crocker, president of Service Title Company, agent for Ross and Jane Atkins, owners, for a license to encroach for a swimming pool, garage, pool apron, and covered storage area exteding up to 7.7 feet into a 15-foot utility easement at the rear of Lot 18, Block 9, Dowlen West, Unit VI and located at 825 Stacewood for a one-time license fee of $500.00. The Consent Agenda was approved on a motion made by Councilman Moore and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- City Manager Haines deferred Agenda Items E. 4 6 5 (An ordinance enacting a new ordinance regulating the operation of wreckers and an ordinance amending Chapter 26 of the Code of Ordinances concerning the towing and impounding of vehicles) for one week. -000- Resolution 87-103 authorizing the filing of an application with the Department of Housing and Urban Development for third year funding in the amount of $128,000 of the Rental Rehabilitation Program (program encourages the rehabilitation of privately- owned rental housing by making interest-free loans available for up to 50 per cent of the rehabilitation costs - usually not to exceed $10,000 for occupation by low income families) was approved on a motion made by Councilman Moore and seconded by Councilman Lee. Question: Ayes: All Nayes: None -000- Resolution 87-104 awarding a three-year contract with Vince Edwards, dba Edwards Lawn Service, for mowing privately owned property to abate weed law violations at $0.00275 a square foot for developed property and $0.0023 a square foot for vacant property or an estimated total of $16,362.00 a year was approved on a motion made by Councilman Brumley and seconded by Councilman Lee. Question: Ayes: All Nayes: None In answer to questions by Council concerning a cancellation clause for non- performance or poor performance, it was stated that a 30-day cancellation clause would be included in the executed contract. In addition, a discussion was held concerning collection rates for liens placed against these properties. It was agreed that a Council Work Session would be held to consider police procedures for increasing the collection rate, possibly through foreclosure proceedings. -197- May 19, 1987 The second reading of an ordinance granting a franchise to Waste Master for the operation of a commercial container garbage collection service was held: AN ORDINANCE ESNTITLED AN ORDINANCE GRANTING A FRANCHISE TO WASTE MASTER TO -OPERATE A COMMERCIAL CONTAINER GARBAGE COLLECTION SERVICE IN THE CITY OF BEAUMONT; PROVIDING THE TERMS, CONDITIONS, OBLIGATIONS, AND LIMITATIONS OF SUCH SERVICE; PROVIDING INDEMNITY TO THE CITY; RETAINING AUTHORITY TO REGULATE RATES; PROVIDING FOR FRANCHISE PAYMENTS AND PROVIDINNG FOR SEVERABILITY. The ordinance was passed to its third and final reading (to be held June 16, 1987) on a motion made by Councilman Samuel and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Councilman Brumley questioned responsibility in clean-up of Riverfront Park after rental of the facility by private individuals for festivities, specifically complaining about the condition of the Park on Monday after the Raft Races that were held Sunday. Councilman Lee told all that the Southeast Texas Arts Council and the Recreation Division of the City will host Riverfront Park's Sunday in the Park activities to be held May 24, 1987 and invited all to bring their families and participate in the fun. Councilmen Brumley and Moore mentioned to those in attendance, "you want to keep up - some thing's about to happen in the City so you want to make sure you don't miss any Council meetings, keep an eye on the paper and the television - something new is about to happen in the City .. . • . It's in the air, folks. You've heard the 'eagle has landed - you ain't seen nottin' yet.'" -000- Mrs. Phyllis Edison Jackson, 5285 Harmony, addressed Council to express her concerns for children's safety in using Riverfront Park and requested that Council consider installation of a fence rather than the chain barrier along the river's edge. Mr. Ernie Shackelford addressed Council to complain that he had been charged with littering in Municipal Court by the Environmental Health Division of the Health Department on property that he does not own nor is in his control. Mrs. Jessie Cooper, 446 Georgetown, addressed Council to speak of the Autocade to the U. S. Constitution Conference to be held in Pennsylvania during July. -198- May 19, 1987 Mr. Earl Massey, 6225 Beau View, addressed Council to request consideration of establishing a policy by Council that requires staff-to -bring recommendations from Advisory Boards to Council for consideration and possible action within a set period of time, saying that Advisory Boards are made up of volunteers who devote many hours to their various Boards and deserve to be heard. Mr. Henry Dannenbaum, 1567 Wall, addressed Council to again speak of half-way houses and group homes. -000- There being no further business, the meeting was recessed before continuing with the City Council Workshop Session. -000- I, Rosemarie Chiappe tta, Secretary for the City Clerk's office, certify that the above is a true copy of the Minutes of the regular City Council session held May 19, 1987.
