BE I'T REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 3rd day of December, 1985, with the following present: HONORABLE: William E. Shelton Interim City Manager Lane Nichols City Attorney -000- The Invocation was given by the Reverend Lonnie Treadway, New Life Tabernacle. 'The Pledge of Allegiance was led by Mayor Neild. -000- The following proclamation was issued: "Christmas Seal Month in Beaumont" - December, 1985. -000- Public comment on Agenda Items 1 through 12 was called: Mr. L. E. Vaughn, 2475 Ranier, addressed Council to express his concern about increasing the speed limit from 35 miles per hour to 40 mph on Eleventh Street from Washington Boulevard to Fannett Road and to request that "school" signs be placed on Fannett Road in the area of West Brook 9th Grade Center for safety of the students. -000- Bids were received by the City of Beaumont and opened by Mr. Frank Ildebrando of Underwood Neuhaus and Assosciated for the issuance of $6.7 million in refunding bonds (proceeds to be used to refund $5.65 million in Waterworks and Sewer System Certificates of Obligation, Series 1985, which were purchased by the Texas Water Board) : First City Rational Bank, Houston, and Associates: Total Interest Cost - $3,723,131.27 average Interest Rate - 9.2798 'Chemical Bank, New York: Total Interest Cost - $8,597,332.50 Average Interest Rate - 9.14075 -275- December 3, 1935 *Underwood Neuhaus and Company: Total Interest Cost - $8,799,005.00 Average Interest Rate - 9.35517 (*Condition: bonds :rust be delivered no later than December 31 , 1985) Mr. Ildebrando and Mr. Cliff Youngblood of Vinson & Elkins will check the bids for accuracy and make a recommendation to Council later in the meeting for sale of these bonds. -000- Resolution 85-411 authorizing execution of a ten-foot underground electrical easement on the Beaumont Community Health Clinic property to Gulf States Utilities Company was approved on a motion made by Councilman Deshotel and seconded by Councilman Turner. Question: Ayes: All Nayes: None -000- Resolution 85-412 authorizing an annual contract for reinforced concrete from National Concrete Products and 7x7x7 box culvert from Pyramid Concrete Pipe Company for installation and replacement of drainage systems was approved on a motion made by Councilman Samuel and seconded by Councilman Turner. Question: Ayes: All Nayes: None -000- An ordinance amending Chapter 26, Section 26-23 of the Code of Ordinances, relating to speed limits (State Department of Highways and Public Transportation recommends an increase in existing speed limit on IH-10 East Frontage Roads between Milam and Washington from 35 to 40 miles per hour; IH-10 West Frontage Roads between Harrison and LNVA Canal from 35 to 40 mph - the State will install and maintain all required speed limit and related signs and City will enforce speed zones. Ordinance changes school speed zone on Pine Street for Lincoln and Martin Schools from Schedule C to Schedule A; deletes school speed zones for North and Harrison Streets at Wilbanks School which is now an Administration Building and changes speed limits on 11th Street between Washington and Fannett to 40 mph) was considered: AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 26, SECTION 26-23 AND 26-24 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT 'TO ESTABLISH MAXIMUMS AND MINIMUMS IN CERTAIN ZONES; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. The ordinance was deferred to a future workshop session on a motion made by Councilman Moore and seconded by Councilman Deshotel. Question: Ayes: All Nayes: None -276- December 3, 1985 Resolution 85-413 awarding bids to Gray Roofing for the reroofing of Fire Station No. 2 at $3,310.00 and Fire Station No. 3 at $4,950.00 was approved on a motion made by Councilman Weisbach and seconded by Councilman Samuel. Question: Ayes: All Nayes: None -000- Resolution 35-414 authorizing an annual maintenance agreement with A. B. Dick at $1,557.00 including all parts, labor and service calls for word processing equipment located in the City Attorney's Office was approved on a motion made by Councilman Deshotel and seconded by Councilman Turner. Question: Ayes: All Nayes: None Councilman Moore requested that when only one bid is received in response to any City bid call, a list of potential bidders that received notice of the bid call from the City be furnished to Council. -000- Resolution 85-415 authorizing purchase of periodicals for the Beaumont Public Library System from National Organization Service, Inc. at $7,358.44 was approved on a motion made by Councilman Brumley and seconded by Councilman Weisbach. Question: Ayes: All Nayes: None -000- Resolution 35-416 authorizing Change Order No. 2 to the contract with Texas Sterling Construction Company for the construction of Contract 13, Railroad Interceptor, to reflect as-built quantities and field changes and final payment In the amount of $99,420.03 to the contractor (total project cost - $1,949,540.99) was approved on a motion made by Councilman Deshotel and seconded by Councilman Turner. Question: Ayes: All Nayes: None -000- 2esolution 85-417 authorizing execution of license agreements for the construction of fiber optic cable with MCI Telecommunications Corporation and U. S. Telecom, Inc. was approved on a motion made by Councilman Deshotel and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Resolution 85-418 awarding bids for purchase of petroleum products for Fleet Maintenance for a 6-months period with an option to purchase for an additional 6 months: 4,500 gallons of engine oil at $10,235.25; 3,250 gallons of hydraulic oil at $5,443.43 from Sitton Oil; 400 gallons of automatic transmission fluid from Texaco Refinery in 1 quart containers at $1,440.00 and 400 gallons of automatic transmission fluid from Sitton Oil in 55 gallon containers at $958.00; Gear Lub` Oil from Signal Oil at $58.00 for 100 pounds and $362.50 for 125 gallons and chassis lube grease from Pro 011 at $60.00 for 100 pounds and $508.75 for 125 gallons, was approved on a motion made by Councilman Brumley and seconded by Councilman Weisbach. Question: Ayes: All Nayes: None -277- December 3, 1935 Resolution 85-419 adopting the Department of Labor's September 20, 1985 highway heavy rates as the current prevailing wage rates but deferring action until Workshop discussion on the Department of Labor's September 13, 1985 building construction rates was approved on a motion made by Councilman Turner and seconded by Councilman Brumley. Question: Ayes: All Nayes: None -000- Resolution 85-420 approving the release of $2.0 million in securities by First City National Bank of Beaumont used as collateral for City deposits was approved on a motion made by Councilman Weisbach and seconded by Councilman Deshotel. Question: Ayes: Councilman Abstained: Mayor Neild Deshotel Councilman Turner Councilman Weisbach Councilman Brumley Councilman Samuel Councilman Moore -000- Ordinance No. 85-127 authorizing the issuance of $6.7 million in refunding bonds (proceeds to be used to refund $6.65 million in Waterworks and Sewer System Certificates of Obligation, Series 1985, which were purchased by the Texas Water Board) was considered: ORDINANCE NO. 85-127 ORDINANCE AUTHORIZING ISSUANCE OF $6,700,000 OF CITY OF BEAUMONT COMBINATION TAX AND REVENUE REFUNDING _BONDS, SERIES 1985A AND AUTHORIZING REDEMPTIONS PRIOR TO MATURITY OF CERTAIN OBLIGATIONS. The Bonds are to be issued to Chemical Bank of New York, total interest cost of $8,597,332.50 at an average interest rate of 9.14075 with the condition that bonds be delivered no later than December 31, 1985. The ordinance was approved on a motion made by Councilman Deshotel and seconded by Councilman Turner. Question: Ayes: All Nayes: None -000- Mayor Neild called an Executive Session subject to Section II of the Texas Open Meetings Act to consider personnel to be held immediately following Workshop Session. -273- December 3, 1935 Mr. Jorge Lopez addressed Council to complain. of discrimination against Hispanics and harrassment by government at all levels.
