The City Council of the City of Beaumont, Texas, met in a regular session on January 7, 1997, at
the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the
following:

Mayor Moore called the meeting to order at 1:40 p.m. Attorney Tom Sibley gave the invocation.
Mrs. Heather Petkovsek, wife of Saint Louis Cardinal baseball pitcher Mark Petkovsek, joined
Mayor Pro Tem Cokinos in leading the pledge of allegiance.
Present at the meeting were: Mayor Moore, Mayor Pro Tem Cokinos, Councilmembers Smith,
Goodson, Ames, Davis, and Patterson. Also, present were Ray A. Riley, City Manager; Lane
Nichols, City Attorney; Patrice Fogarty, City Clerk; and Barbara Liming, Deputy City Clerk.
Mayor Moore complimented the Keep Texas Beautiful ceremony held at 12:30 p.m. today when
the City of Beaumont was awarded a prize for scoring second in a statewide recycling contest by
collecting candidate election signs after the general election in November. He commended radio
station KYKR, the Keep Beaumont Beautiful Commission, David Oliver, the commission's
coordinator, the City's Clean Community Division and Recycling Center staff for their cooperative
efforts in making the award possible.
Mayor Moore announced that an executive session will be held following the regular session of City
Council in accordance with Section 555.071 of the Government Code to discuss contemplated or
pending litigation: Mark Spivey v. City of Beaumont, et al; Kenneth Karr, et al v. City of Beaumont,
et al; Danise Wallace, et al v. City of Beaumont, et al; and the claim of Edward Fermon.
• Citizens were invited to comment on the consent agenda and main agenda items 5-8. No
one wished to address these subjects.
CONSENT AGENDA
The following consent agenda items were considered:
Approval of the minutes of the December 17, 1996, meeting;
Confirmation of committee appointments - Resolution No. 97-1;
A. Authorize the acquisition of property for the Charlton Pollard Neighborhood Revitalization
Project - Resolution No. 97-2;
B. Authorize the payment of an invoice for emergency repairs to a pump in the storm sewer
system which drains the Irving Street underpass - Resolution No. 97-3;
Mayor Pro Tem Cokinos moved to approve the consent agenda.
Councilmember Davis seconded the motion. MOTION PASSED.

GENERAL BUSINESS
1. Consider a request for a zone change from RM-H (Residential Multiple Family Dwelling-
Highest Density) to GC-MD (General Commercial-Multiple Family Dwelling) for property
located at 4220 Treadway Road.
Councilmember Smith moved to adopt Ordinance No. 97-1, ENTITLED AN
ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT,
TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS, AS
INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE
ZONING OF PROPERTY PRESENTLY ZONED RM-H (RESIDENTIAL MULTIPLE FAMILY
DWELLING-HIGHEST DENSITY) DISTRICT TO GC-MD (GENERAL COMMERCIAL-
MULTIPLE FAMILY DWELLING)FOR A 0.654 ACRE TRACT OF LAND AT 4220 TREADWAY
ROAD, BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Councilmember Ames
seconded the motion. MOTION PASSED.

2. Consider a request to rezone two abutting tracts of land between Dowlen Road and
Wellington from RS (Residential Single Family Dwelling) and RM-H (Residential Multiple
Family-Highest Density) to NC (Neighborhood-Commercial).

3. Consider a request for a specific use permit to allow the operation of a residential care
facility at 695 Irma Street in an RCR (Residential Conservation and Revitalization) District.
Councilmember Davis moved to approve ORDINANCE NO. 97-3, ENTITLED
AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW THE
OPERATION OF A RESIDENTIAL CARE FACILITY IN AN RCR (RESIDENTIAL
CONSERVATION REVITALIZATION) DISTRICT AT 695 IRMA STREET, IN THE CITY
OF BEAUMONT, JEFFERSON COUNTY, TEXAS. Councilmember Smith
seconded the motion. MOTION PASSED.

4. Consider a request for a specific use permit to allow an entertainment, recreational services
and rental hall in a GC-MD (General Commercial-Multiple Family Dwelling District at 3410-
3440 Concord Road.
Councilmember Davis moved to adopt ORDINANCE NO. 97-4, ENTITLED AN
ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW AN
ENTERTAINMENT, RECREATIONAL SERVICES AND RENTAL HALL, WITH THE
OCCASIONAL SALE OF ALCOHOLIC BEVERAGES IN A GC-MD (GENERAL
COMMERCIAL - MULTIPLE FAMILY DWELLING) DISTRICT AT 3410-3440
CONCORD ROAD, IN THE CITY OF BEAUMONT,JEFFERSON COUNTY,TEXAS.
Councilmember Patterson seconded the motion. MOTION PASSED.

5. Consider awarding a bid and authorizing the execution of a contract for the construction of
the Elmo Willard Branch Library.
Councilmember Davis moved to adopt Resolution No. 97-4. Councilmember
Ames seconded the motion. MOTION PASSED.

6. Consider the purchase of pursuit vehicles for use in the Police Department.
Mayor Pro Tem Cokinos moved to adopt Resolution No. 97-5.
Councilmember Smith seconded the motion. MOTION PASSED.

7. Consider approving a one-year contract with the Chamber of Commerce.
Mayor Pro Tem Cokinos moved to adopt Resolution No. 97-6.
Councilmember Smith seconded the motion. MOTION PASSED.

8. Consider authorizing a contract extension with the Southeast Texas Community
Development Corporation for the expenditure of funds related to the city's HOME Grant
Program.
Mayor Pro Tem Cokinos moved to adopt Resolution No. 97-7.
Councilmember Smith seconded the motion. MOTION PASSED.

Following positive comments by councilmembers regarding the revitalization of the Charlton
Pollard neighborhood with the construction of new homes, Mayor Moore reflected about the
initial beautification and revitalization efforts of the SCOUP program in 1989 and the
ultimate blossoming of that community today.

COMMENTS
Councilmember Smith remarked about resuming schedules after holiday celebrations and
illnesses, congratulated those responsible for Beaumont being rewarded and recognized
today for recycling efforts, expressed concern and perplexity with continued littering within
the city, proposed further development of effective education techniques or incentives as
a goal for 1997 to encourage or stimulate individual personal pride in our community.
Councilmember Goodson reported an active and well attended meeting of the ACORN
association, expressed appreciation to the City Manager, Department and Division leaders
for their support to the group, commented about the dedicated volunteer service of various
members of boards and commissions who have fulfilled their terms of office and suggested
they be considered for placement on other committees because of their intense commitment
and level of service to the city.
Councilmember Davis extended new year greetings and requested that Council consider
a retreat sometime in January to brainstorm and evaluate issues that could serve the city
well.
Councilmember Patterson recounted the advances and headway made for the city in 1996
and predicted that 1997 will be even more productive and progressive.
Councilmember Ames added new year greetings, congratulated the Keep Beaumont
Beautiful Commission, the Clean Community Division, John LaBrie, David Oliver, Kathy
Scofield and all those involved in making the recycling award possible today. She explained
that Mr. Ben Walker (her brother) was scheduled to present the award from the Steel
Recycling Institute today, but was unable to be here because inclement weather prohibited
air travel.
Mayor Moore asked Council to consider January 28th as a possible retreat date, spoke of
the successes of 1996 and challenges of 1997 that can be positively overcome through
unified efforts. He added comments about the teamwork efforts and diversity of this Council,
thanked the City Manager, Department Heads, employees and citizens for contributing to
the effectiveness of city operations and commented about working together with recently
elected Congressman Nick Lampson.
PUBLIC COMMENTS (Persons are limited to 3 minutes)
Ms. Lisa Sutter, a recent resident at 695 Irma Street, addressed Council in support of
keeping the Watts Home open for displaced individuals and told about help she received
there.
The applicant for Agenda Item 4 requesting a specific use permit for an entertainment
recreational service and rental hall at 3410-3440 Concord Road (no name or address

stated) thanked Council for supporting his request, said he will work with the neighborhood
and feels the city will approve of his actions.
There being no further business, the meeting recessed at 2:38 p.m. to reconvene in executive
session.
