The City Council of the City of Beaumont, Texas, met in a regular session on October 29, 1996,
at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:37 p.m. to consider the
following:

Mayor Moore called the meeting to order at 1:37 p.m. The Reverend Larry Selvey, Northside.
Church of Christ gave the invocation. Brandon, a third-grade student from Saint Anthony
Cathedral School, led in the pledge of allegiance.
Present at the meeting were: Mayor Moore, Mayor Pro Tem Cokinos, Councilmen Ames, Smith,
and Davis. Councilmen Goodson and Patterson were absent. Also, present were Ray A. Riley,
City Manager, Lane Nichols, City Attorney, Patrice Fogarty, City Clerk, and Barbara Liming, Deputy
City Clerk.
Mayor Moore welcomed 25, third-grade students from Saint Anthony Cathedral School observing
today's City Council meeting and invited their comments. Students expressed appreciation for the
opportunity to attend a Council meeting as part of their field trip.
Ms. Maria Vickers, representing the YWCA, presented Mayor Moore with their "Mission Award"
trophy for his contribution to the community in combating violence. Mayor Moore was honored
recently at the McCabe-Roberts Methodist Church at a special program.
One proclamation was issued: "Restaurant Month," October, 1996.
Citizens were invited to comment on the Consent Agenda and Main Agenda Items 4-8. No one
wished to comment on these subjects.
CONSENT AGENDA
The following consent agenda items were considered:
* Approval of minutes of the October 22, 1996, meeting;
a. Confirmation of committee appointments - No appointments made
b. Authorize the acquisition of property for the Charlton-Pollard Neighborhood Revitalization
Project - Resolution No. 96-261.
C. Authorize the conveyance of four properties to Statewide Consolidated Community
Development Corporations, Inc. for construction of homes for the Charlton-Pollard
Neighborhood Revitalization Project - Resolution No. 96-262
Mayor Pro Tem Cokinos moved to approve the consent agenda.
Councilman Ames seconded the motion. MOTION PASSED.

GENERAL BUSINESS
1. Consider a request for a specific use permit to allow the construction of a new church on
property in an RS (Residential Single Family Dwelling) District.
Mayor Pro Tem Cokinos asked that the Ordinance ENTITLED AN
ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW A NEW CHURCH
IN AN AREA ZONED RS (RESIDENTIAL SINGLE FAMILY DWELLING) DISTRICT
FOR PROPERTY LOCATED ON THE EAST SIDE OF 23RD STREET, 496 FEET
SOUTH OF CARTWRIGHT AVENUE IN THE CITY OF BEAUMONT, JEFFERSON
COUNTY, TEXAS be deferred to allow members of the Unity Church to
meet with members of the South 23rd Street Neighborhood Association
in an effort to come to a common ground and improve their
communication. Council concurred with the request.
2. Consider a request for a zone change from RM-H (Residential Multiple Family
Dwelling-Medium Density) to RM-H (Residential Multiple Family Dwelling-
Highest Density) District for property located on Gladys between Shakespeare
and Galway and a specific use permit for two 1-story office buildings.
Mayor Pro Tem Cokinos moved to adopt Ordinance No. 96-62
ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF
ORDINANCES OF BEAUMONT,TEXAS,AND IN PARTICULAR THE BOUNDARIES

OF THE ZONING DISTRICTS, AS INDICATED UPON THE ZONING MAP OF
BEAUMONT, TEXAS, BY CHANGING THE ZONING OF PROPERTY PRESENTLY
ZONED RM-M (RESIDENTIAL MULTIPLE FAMILY DWELLING-MEDIUM DENSITY)
TO RM-H (RESIDENTIAL MULTIPLE FAMILY DWELLING-HIGHEST DENSITY)
DISTRICT FOR PROPERTY LOCATED IN THE 7800 BLOCK OF GLADYS AVENUE,
BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Councilman Smith
seconded the motion. MOTION PASSED.

Councilman Smith made a motion to approve Ordinance No. 96-63
ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW
CONSTRUCTION OF TWO (2) ONE-STORY OFFICE BUILDINGS IN AN RM-H
(RESIDENTIAL MULTIPLE FAMILY-HIGHEST DENSITY DWELLING) DISTRICT, IN
THE CITY OF BEAUMONT,JEFFERSON COUNTY,TEXAS. Councilman Ames
seconded the motion. MOTION PASSED.
Ayes: Mayor Moore, Mayor Pro Tem Cokinos, Councilmen
Smith, Ames, and Davis
Noes: None
3. Consider a request from the Beaumont Independent School District to close and abandon
certain streets and alleys within a four block area in the Blanchette Second Addition being
developed for the new Martin Luther King, Jr. Middle School.
Councilman Smith moved to adopt Ordinance No. 96-64, ENTITLED AN
ORDINANCE CLOSING AND ABANDONING CERTAIN STREETS AND ALLEYS
WITHIN A FOUR BLOCK AREA IN THE BLANCHETTE SECOND ADDITION IN THE
CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. Councilman Davis
seconded the motion. MOTION PASSED.

Smith, Ames, and Davis
Noes: None
4. Consider approving the notice of sale and the preliminary official statement and authorizing
the distribution of such documents in order to sell $28,880,000 in Refunding Bonds.
Councilman Smith moved to adopt Resolution No. 96-263 approving
preliminary steps to sell $28,880,00 in Refunding Bonds, Series 1996A
until November 12, 1996. Councilman Ames seconded the motion.

5. Consider a change order with Bo-Mac Contractors to reduce the size and cost of a
construction project to build a ground storage tank near the Prison Complex Pump Station
site.
Mayor Pro Tem Cokinos moved to adopt Resolution No. 96-264,
authorizing a change order decreasing the original contract amount by
$234,876 for a revised contract amount of $959,600. Councilman
Davis seconded the motion. MOTION PASSED.

Smith, Ames, and Davis
Noes: None
6. Consider a revision to the City of Beaumont Investment Policy.
Councilman Ames moved to adopt Resolution No. 96-265, amending
the Investment Policy. Councilman Smith seconded the motion.
MOTION PASSED.

Smith, Ames and Davis

7. Consider acceptance of the property tax assessment roll for the 1996 tax year as
presented by the Jefferson County Tax Assessor-Collector.
Councilman Ames moved to adopt Resolution No. 96-266, approving
thetax roll as certified by the Jefferson County Tax Assessor-Collector.
Councilman Smith seconded the motion. MOTION PASSED.
Ayes: Mayor Moore, Mayor Pro Tem Cokinos, Councilmen
Smith, Ames, and Davis.
Noes: None
8. Consider an amendment to Section 21-6 of the Code of Ordinances relating to standard
leave benefits.
Councilman Smith moved to adopt Ordinance No. 96-65, ENTITLED AN
ORDINANCE AMENDING CHAPTER 21, SECTION 21-6 OF THE CODE OF

ORDINANCES OF THE CITY OF BEAUMONT DEALING WITH EMPLOYEES' LEAVE;
PROVIDING FOR SEVERABILITY;AND PROVIDING FOR REPEAL. Councilman
Ames seconded the motion. MOTION PASSED.
Ayes: Mayor Moore, Mayor Pro Tem Cokinos, Councilmen
Smith, Ames, and Davis.
Noes: None
COMMENTS
Councilmembers comment on various matters.
Councilman Davis commented about the success of Cops and Kids
event held last Saturday.
Mayor Moore reported that again there were many activities this
weekend in the community that included thousands of participants at
the Cops and Kids celebration at the Fairgrounds that drew observers
throughout the state, congratulated the Southend Community Group for
sponsorship of a senior citizen breakfast activity on Saturday and the
program held at East Mount Olive Baptist Church, and said that other
events included sponsorship by the Texas Committee at the Holiday
Inn, Lamar University's October Weekend, Mobil Oil's company picnic
and the presence of Martin Luther King, III in our community on
Sunday. Mayor Moore added that Pietzsch Elementary School has
been recognized in Texas Monthly for the outstanding test scores of
their students and commended the principal for her innovation and
dedication to education, spoke of the achievements of Operation One
Vote, spearheaded by Councilman Patterson, called attention to graffiti
and defacement of property and asked that citizens report known
offenders to the Police Department and join together in purposing to
keep our city clean and mentioned the Art Museum's exhibit
recognizing the Mexican-American culture.
Public Comment (Persons are limited to 3 minutes)
Mrs. Sandra Chavis, 3925 Concord Road, spoke about the loss of
twins in a house fire five years ago, the inability to financially rebuild
her home, the house being demolished by the City and costs
assessed to her and asked for assistance.

Mr. Darrell Joel White, 2305 Sarah, complained about treatment by
police officers and a Municipal Court judge.
Mr. Tony Jones, 3515 East Lucas, thanked Council for the
proclamation honoring restaurants and spoke of the job opportunities
provided by restaurant owners.
Mr. Benny Mendosa, 5655 South Kenneth, thanked members of
Council for attending a recent community meeting at Christo Rey
Church. Mayor Moore and Councilman Davis offered assistance with
establishment of their neighborhood association and introduced Kyle
Hayes and Tom Warner as the City employees who helped with their
street light request.
There being no further business, the meeting adjourned at 2:25 p.m.
