No one wished to address these topics. -000- The following Consent Agenda items were considered: Approval of the Minutes of the City Council meeting held September 17, 1996; Resolution No. 96-224 authorizing payment in the amount of $73,155.28 to International Business Machine Corporation for renewal an annual computer maintenance agreement for the mainframe computers (AS/400) and peripheral equipment located in City Hall-and the Police Department beginning October 1,1996 and ending September 30, 1997; and Resolution No. 96-225 authorizing authorizing a contract with Compu-Tech in the amount of $19,999.88 for an annual computer software maintenance agreement for sixteen (16) various software applications (Central Collections, Municipal Court, Landfill, Utility Billing, Alarms Billing, Sub-Standard Billing, Work Management, MDT Systems, Probations Tracking for Police and Fire, Drug Testing, Fire Roster, ADA Compliance Tracking, Police TLETS Monitor, Ach Software, Direct Billing-Water and Sub-Standard Building) effective October 1, 1996. The Consent Agenda was approved on a motion made by Mayor Pro Tem Cokinos and seconded by Councilman Ames. Question: Ayes: All Nayes: None -000- Ordinances authorizing a zone change from RS (Residential Single Family Dwelling) District to PUD (Planned Unit Development) District and an application for a Specific Use Permit for a residential care facility on a 5.271 acre tract located on the south side of Delaware Street between the Hillebrandt Bayou and the proposed Savannah Trace with recommendations from the Planning Director and the Planning Commission for denial were considered: ORDINANCE NO. ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS, AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING OF PROPERTY PRESENTLY ZONED RS 290 September 24, 1996 (RESIDENTIAL SINGLE FAMILY DWELLING) DISTRICT TO PUD (PLANNED UNIT DEVELOPMENT) FOR PROPERTY LOCATED ON THE SOUTH SIDE OF DELAWARE BETWEEN THE HILLEBRANDT BAYOU AND THE PROPOSED SAVANNAH TRACE, BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. and ORDINANCE NO. ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW THE CONSTRUCTION OF A TWO-STORY STRUCTURE FOR A RESIDENTIAL CARE FACILITY CONTAINING 66 UNITS IN A PUD (PLANNED UNIT DEVELOPMENT) DISTRICT FOR PROPERTY LOCATED ON THE SOUTH SIDE OF DELAWARE BETWEEN THE HILLEBRANDT BAYOU AND THE PROPOSED SAVANNAH TRACE IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. The Ordinance authorizing a zone change from RS (Residential Single Family Dwelling) District to PUD (Planned Unit Development) District for the property located on the south side of Delaware east of the Hillebrandt Bayou was denied on a motion made by Councilman Smith and seconded by Councilman Davis. Question: Ayes: All Nayes: None Because the zone change was denied, no official vote was taken or required for the Specific Use Permit. Councilmembers Goodson and Smith encouraged developers of the proposed residential care unit to pursue their goal in meeting the needs of senior citizens by providing assisted living accommodations and explained that they support the project, but denial is based only on the inappropriateness of the facility in this location and the commitment that must be honored to the neighborhood. Councilman Davis concurred with comments of Councilmen Goodson and Smith and invited consideration of Ward III as a location for the facility. -000- Ordinance No. 96-52 authorizing a Specific Use Permit at the request of Dolores Chandler who 291 September 24, 1996 wishes to operate a day care center for sixty (60) children from 6:30 a.m. to 6:00 p.m. with an option to keep up to ten (10) children at night to 11:00 p.m. in an area zoned RM-H (Residential Multiple Family Dwelling-Highest Density) District at 2365 Wescalder Road was considered: ORDINANCE NO. 96-52 ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW A DAY CARE CENTER FOR CHILDREN AT 2365 WESCALDER ROAD IN AN RM-H (RESIDENTIAL MULTIPLE FAMILY-HIGHEST DENSITY DWELLING) DISTRICT, IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. As a matter of clarification to citizen inquiry, Councilman Goodson confirmed with Planning Director Steve Richardson that the City approves zoning and Specific Use Permits for such operations, and the State Licensing Board approves the number of children to be supervised. Ordinance No. 96-52 was approved on a motion made by Councilman Goodson and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Ordinance No. 96-53 authorizing a Specific Use Permit for a 0.1371 acre tract, part of the parking lot of Orthopaedic Properties, Inc. (Beaumont Bone and Joint Clinic), which lies in an RM-H (Residential Multiple Family Dwelling-Highest Density) District at 3650 Laurel Avenue was considered: ORDINANCE NO. 96-53 ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT FOR PART OF A MEDICAL CLINIC'S PARKING LOT WHICH LIES IN AN RM-H (RESIDENTIAL MULTIPLE FAMILY DWELLING-HIGHEST DENSITY) DISTRICT AT 3650 LAUREL AVENUE, IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance No. 96-53 was approved on a motion made by Mayor Pro Tem Cokinos and seconded by Councilman Smith. Question: Ayes: All Nayes: None 292 September 24, 1996 Ordinance No. 96-54 abandoning a 16' x 157.72' utility easement which lies along the south 157.72' of Lot 23, Block 22, Dowlen West Addition, Unit XI 1, 710 Brandywine, at the request of Kirk E. Martin to construct an accessory structure, was considered: ORDINANCE NO. 96-54 ENTITLED AN ORDINANCE ABANDONING A 16' X 157.72' PLATTED UTILITY EASEMENT LYING ALONG THE SOUTH 157.72' OF LOT 23, BLOCK 22, DOWLEN WEST ADDITION, UNIT XII, IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance No. 96-54 was approved on a motion made by Mayor Pro Tem Cokinos and seconded by Councilman Davis. Question: Ayes: All Nayes: None -000- Resolution No. 96-226 accepting the work performed and authorizing final payment in the amount of$16,308.41 to Placo, Inc. for construction of a Wastewater Lift Station located at the Federal Prison Site on Hebert Road was approved on a motion made by Mayor Pro Tem Cokinos and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Councilman Goodson thanked Water Utilities Department Director S. A. Webb and his staff for prompt attention and responsiveness to recent drainage problems. Councilman Davis commented about the success of the Fifteenth Annual NAACP Banquet last Saturday and requested a meeting with the City Manager and Police Chief to submit a flavor of the comments he has received from the grass roots level regarding the tragic death of Lawrence Lewis. Mayor Moore added his compliments to Mr. Webb and the Water Utilities Department for resolving a citizen complaint that he submitted to them, welcomed City Clerk Patrice Fogarty back to Council and extended condolences and remembrances in prayer to her in the recent loss of her mother.. Also, Mayor Moore reminded the City Manager of the need to keep aware of the spectrum issue and communication access. -000- Mr. Tony Jones, 3715 East Lucas, addressed Council regarding a new piece of equipment received 293 September 24, 1996 from the Texas State Library by the Beaumont Public Library called a full circuit television that enlarges printed material onto a television screen to aid the elderly and sight-impaired to be able to read regular printed books. Mr. Jones said he has requested that a grant application be submitted to receive a second viewer for placement at the new northend library that will be constructed at East Lucas and Helbig Road. -000- There being no further business, the meeting was recessed to convene in executive session. -000- 1, Patrice Fogarty, City Clerk for the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the regular City Council session held September 24, 1996.
