BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 5th day of March, 1996, with the following present: HONORABLE: David W. Sanders Assistant City Attorney Barbara Liming Deputy City Clerk -000- The Invocation was given by Councilman Davis. The Pledge of Allegiance was led by Mayor Moore. -000- As part of Black History Month, Mayor Moore and Councilman Patterson were recognized last Sunday by the Reverend Clarence Williams and congregation at East Mount Olive Baptist Church, and today Mrs. Marie Hubbard and Councilman Davis presented them with plaques from the church that read, "Dedicated to David Moore, Beaumont's first Black Mayor" and "Dedicated to Bobbie Patterson, Beaumont's first Black Councilwoman" with the name of the church and pastor inscribed. Mayor Moore expressed appreciation for the recognition, thanked Mrs. Hubbard for the church's invitation to attend the special service highlighting Black history and said that everyone had an opportunity to learn something new and that "all history should be everybody's history because we learn from each other." He said it was a most enjoyable Sunday morning and thanked Mrs. Hubbard for the emphasis in the community. Councilman Patterson added her thanks, agreed that it was an excellent program, said she was honored to be there and learned a lot more about 82 March 5, 1996 Black history. -000- Citizen comment was invited on the Consent and Main Agenda. No one wished to addressed these items. -000- The following Consent Agenda item was considered: Approval of the Minutes of the City Council meeting held February 27, 1996; and Resolution No. 96-59 appointing Lee Woodward to the Keep Beaumont Beautiful Commission for a term expiring March 4, 1998. The Consent Agenda was approved on a motion made by Councilman Cokinos and seconded by Councilman Davis. Question: Ayes: All Nayes: None -000- Ordinance No. 96-17 amending Section 10-21(a) of the Code of Ordinances which regulates storage of flammable liquids and explosives in aboveground tanks of ten thousand gallons or less to specifically include liquefied petroleum gas within the regulation was considered: ORDINANCE NO. 96-17 ENTITLED AN ORDINANCE AMENDING CHAPTER 10, SECTION 10-21(a) OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO INCLUDE LIQUID PETROLEUM GAS WITHIN THE REGULATION FOR THE STORAGE IN ABOVEGROUND TANKS OF TEN THOUSAND (10,000) GALLONS OR LESS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Councilman Cokinos questioned the amount of liquefied petroleum gas in Beaumont, in what areas it is allowed and the safety of the amounts transported by rail. Fire Marshall Jack Maddox responded that above ground storage of any flammable combustible is in Heavy Industrial, Light Industrial and General Manufacturing zones and said that railroads fall 83 March 5, 1996 under federal jurisdiction and the City does not have the right to enforce any codes on state or federal agencies. Ordinance No. 96-17 was approved on a motion made by Councilman Cokinos and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Resolution No. 96-60 authorizing the marketing plan for visitor development and approve an appropriation of $88,000 from the unreserved balance of the Hotel Occupancy Tax Fund to market the plan through the Media (outdoor, newspaper, radio and television advertising), $50,000; Special Programs (image development and consumer research), $10,000; Special Services (video production, photographic library, media promotion kit); and Printing (motor coach tour manual), $10,000 was approved on a motion made by Mayor Pro Tem Ames and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Resolution No. 96-61 authorizing acquisition of improvements for Parcel 43: a 0.773 of an acre out of Lots 1 and 2, Block 7, Wescalder Fig Acres Addition (2050 South Major Drive) for total compensation of $90,997.00 ($91,000 less $3.00 for retained improvements) from Market Place of Texas, Inc. that were not previously considered in the original acquisition authorized by Resolution No. 96-47 for the FM364/Major Drive project, was approved on a motion made by Councilman Cokinos and seconded by Mayor Pro Tem Ames. Question: Ayes: All Nayes: None -000- Resolution No. 96-62 endorsing the grant application by the Jefferson Theatre Preservation Society from the Intermodel Surface Transportation Efficiency Act (ISTEA) to renovate the historic Jefferson Theatre, guaranteeing a 20% match, recommending the project for "enhancement funding" by the Texas Department of Transportation and confirming that Statewide Transportation Enhancement Program application funds will be utilized, in part, to meet local, state and federal codes and regulation pertaining to ADA, fire, safety and heath requirements was approved on a motion made by Councilman Smith and seconded by Councilman Cokinos Question: Ayes: All Nayes: None 84 March 5, 1996 Mr. Kyle Hayes, assistant to City Manager Ray Riley, presented a report to Council about vacant facilities and lots owned by the Beaumont Independent School District that could possibly be acquired through Community Development Block Grant funds for future construction and development. Four of the properties are Dowlen Middle School, Edwards Elementary School, Giles School and the former BISD Administration Building as described on the attachment to the City Council Minutes. Mr. Hayes said acquisition of the four properties at appraised value would total $226,000 and would allow the School District to comply with a recommendation of the Sharp Report and receive needed funds for acquisition of Block 4 of the Blanchette 1 Survey for expansion of Fletcher School. He said the City would have an opportunity to revitalize four areas of town and remove dangerous eyesores in neighborhoods. Council discussion included questions concerning use of a building for City storage, instead of demolition, another use for the BISD Administration Building because its downtown location, asked if any of the properties are located in non-impacted areas that could be used by the Beaumont Housing Authority, a request to move forward with Fletcher Park, a request for information from the School Superintendent about the MILK Junior High project and community center, other possible uses for the Edwards Elementary facility, building a library at the Giles site versus housing, and a request for a breakdown of estimated demolition costs per foot for each site and a future presentation of demolition, rehabilitation and possible options. -000- Councilman Patterson reminded everyone that early voting for the March 12th Primary Election is being conducted now, encouraged everyone to vote, announced that tomorrow night Operation One Vote will sponsor a "get out to vote" rally and talk to the candidates at the John Gray Institute at 6:30 p.m. and said that a new slogan she is using is "A voteless people is a hopeless people, a decision less people is a vision less people, and where there is no hope, there is no vision and where there's no vision, the people perish." Councilman Davis reported a request for emergency housing for Mr. R. L. Allen, 1885 Glasshouse, submitted street light requests for residents at 1090 Silver, 1050 Delaware, 4365 Galveston and 2625'/ Cable and asked for regular Police patrol in the 3100 block of Tracy because of criminal activity-"maybe a drug dealing situation." Mayor Pro Tem Ames said she had opportunity to attend the Tyrrell Park Neighborhood Association meeting and many lighting requests were also submitted and she would relay them to Staff later. She said since said the Citizens on Patrol program has begun, they have observed the lack of lighting and said there was also much discussion about problems on Sunday nights at Tyrrell Park. Councilman Cokinos commented about the opening of Henry's Place at 1107 McFaddin, a facility that will provide a place for the homeless during the day named in honor Henry Dannenbaum. Henry was a frequent visitor to City Council. Also, Councilman Cokinos complimented the ACORN 85 March 5, 1996 Neighborhood Association, said they presented problems with speeding on Landis and Greeves and requested that DD6 be alerted to clean out their ditches because is a dike has formed at the railroad and pipelines. Councilman Goodson said he also attended the ACORN meeting and added Gross Street to the list for the Police Department to observe speeders, said they would like an update on a park site for their area in time for the April meeting and have asked for a proposed location of the park improvements and where lights in the park. He said originally, the park was planned primarily for small children and not for evening hour activity. He said they also discussed street lighting needs and suggested that perhaps a dissection of the overall list of street lighting design for Tyrrell Park and the Amelia areas could be prepared and given to the two neighborhood associations for inclusion in their newsletter. Councilman Smith reported that she has had complaints of illegal parking at Halbouty Park, graffiti on the Santa Fe Railroad signals at Helbig and said her understanding is that when Helbig and Halbouty parks were developed, basketball courts would not be placed at Halbouty Park because it is a small neighborhood park with very limited parking, but the two basketball courts there attract a number of people and create a dangerous atmosphere because of the overflow of vehicles. She said the basketball goals need to be placed at Lefler Park with adequate parking, said perhaps tow-a-way signs should be erected and enforced, ask that the parks be visited, assess the problems and perhaps a workshop held. During further discussion, Councilman Smith mentioned a vacant house in disrepair adjacent to the park that might be obtained from the estate of the recently deceased owner and used to provide additional parking and solve the problem. Mayor Moore added comments about the ribbon cutting at Henry's Place, reminisced of Henry's visits to Council, spoke of the number of agencies and volunteers that make operation of this facility possibe, explained that anyone can become involved at Henry's Place and commented about the casting this weekend of local residents for a Kellogs commercial and complimented the Convention and Visitors Department for attracting the shooting in Beaumont. -000- Mayor Moore said that before going into public comment, he would like to bring focus on a couple of things, as well as explain a few more, so there will not be misunderstandings. He asked that when speakers come to the microphone that they speak three to five minutes, and if additional time is needed, make an appointment with the appropriate Councilmember to complete expressing their views. He explained that a conscientious effort is being made to adhere to the five minute time limit, said Council will attempt not to interject comments during the speaker's allotted time and said a timer is going to be used to assure equal time for everyone. Mayor Moore clarified that he desires to treat everyone the same and opened the microphone for citizen comment, admonishing them to state their name and address and limit comments to three to five minutes. 86 March 5, 1996 Mr. Roberto Flores, 2425 Buchanan, distributed information he said had bearing on his remarks and listed names of Hispanic citizens to be considered as committee appointments, spoke of the School District wanting to acquire four lots instead of three for Fletcher and extended an invitation to attend an Hispanic Awareness Fair on March 17 to learn about the Hispanic community and said. interpreters would be on site to assist. Mrs. Ella Flores, 2425 Buchanan, addressed Council to complain about being charged for parking on the City parking lot to enter Riverfront Park when activities are being held at the Civic Center. Council assured Mrs. Flores there is no charge for Riverfront Park parking and that Allright Parking would be notified to advise their attendants. Mrs. Flores stated that Hispanic residents want to become involved in community service, and Councilman Davis told her that attending the neighborhood association meetings is a good way to become familiar with community needs and gain experience. Mrs. Selena Valdez, 2225 South Street, addressed Council to discuss Hispanic community involvement, suggested Sunday activities and offered their church for a neighborhood meeting. Mrs. Chris Waite, 6255 Comstock, told Council she lives near Lefler Park and can confirm earlier remarks made, said this is her first opportunity to attend a Council meeting and glad to be able to put a face and name together and said citizens do have an empowering opportunity. Mr. Allen Lee, 5095 Maddox, said a non-profit organization called Concerned Citizens and Tax Payers of America has been formed to assist those who seek justice when they encounter injustice, said he presented the City Attorney with a notice of lawsuit and distributed copies to Council, spoke of his efforts to get Tyrus Germaine Williams, a Courtroom escapee, to turn himself into authorities, a meeting with Enterprise Staff, said he has secured the services of Attorney Jack Lawrence, discussed the Civilian Review Board and Charlton-Pollard Neighborhood Revitalization. Mr. Lee's time to speak expired, and Mr. Charles Johnson offered to relinquish his opportunity to speak to Mr. Lee and was informed that is not a part of Council format, and Mayor Moore offered to meet with Mr. Lee after Council. Mrs. Glenda Dent, 2070 Harriot, addressed Council regarding cleaning ditches on Harriot Street, street repairs, in support of a Police Review Board and spoke of her son being ticketed because a 3'/ year old child was not in a car seat. Mrs. Marie Hubbard, 1990 Nora, addressed Council to discuss the origin of the Community Development Block Grant Commission and said the Commission met yesterday and traveled by bus to peruse sites that might receive CDBG funding. She said Mr. Chappell reviewed each site and the Commission discussed options. Mr. Tony Jones, 3715 East Lucas, addressed Council to request that a plaque honoring Henry Dannenbaum be added at the central transfer point that has been named after Henry, requested 87 March 5, 1996 that a traffic signal device be placed in the 3700 block of East Lucas for the safety of residents of Lucas Gardens walking to the HEB Pantry Store, and spoke in support of recent improvements in the Transit System service. Mr. Damon Keelan, 950 Sherman, addressed Council in support of the Charlton Pollard Neighborhood Revitalization, said revitalization has been discussed since 1985, said Hemlock is the cutoff point for construction, and expressed his desire to rebuild the neighborhood. -000- Mayor Moore announced that a Council meeting will not be held next week. -000- There being no further business, the meeting was adjourned. -000- 1, Barbara Liming, Deputy City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the regular City Council session held March 5, 1996. Riley, City Manager FROM: Kyle Hayes, Assistant to the City Manager SUBJECT: Workshop concerning the purchase of abandoned BISD properties DATE: March 1, 1996 COMMENTS The Beaumont Independent School District owns and maintains several vacant facilities and lots. Four vacant properties in particular may be of interest to the City for redevelopment purposes. Each of the four properties are discussed below. The buildings located on the properties have no contributory value to the land. 1) Dowling Middle School Property The above property is a 3.7 acre tract having frontage on North, McFaddin, Ewing, and Oakland streets. If acquired, residential housing could be constructed on the property. The property has an appraised value of$30,000. 2)Edwards Elementary School Property The above property is a 6.23 acre tract located in the north end. The property is surrounded by Galveston Avenue,Filmore Street,Wilson Street, and Buffalo Avenue. Residential houses with a few commercial pockets are located in the surrounding neighborhood. The property would be ideal for further residential development. The property has an appraised value of$69,000. 3) Giles School Property The 4.56 acre tract is bound by Elgie Street, Chaison Avenue, Church Street, and Avenue A in the south end. The property is located in a residential neighborhood, and approximately twenty- six lots could be platted for the construction of additional housing. The property has an appraised value of$55,000. 4) Former BISD Administration Building The building is located downtown on a 1.09 acre tract. The building fronts west on Trinity Street, north on Wall Street, and east on Neches Street. The property has an appraised value of $72,000. ATTACHMENT With Council approval, the City could purchase the four vacant properties at the their appraised values which total $226,000. The appraisals were conducted by Jack C. Aulbaugh, a certified appraiser. Community Development Block Grant funds would be used for the acquisition of the properties over three Block Grant Program years. The City and School District have been working collaboratively together over the past year, and the purchase of the four properties would be a win-win situation. First, the School District would rid itself of abandoned property as recommended in the Sharp Report. Second, the School District would receive needed funds for the acquisition of other properties for use in their construction program. The School District would use the proceeds to acquire Block 4 of the Blanchette 1 Survey for the expansion of Fletcher School. The School District had plans to acquire Blocks 5, 21, and 4 which surround the school, but due to a lack of funds could only acquire Blocks 5 and 21. The additional proceeds will enable the School District to buy Block 4 and further revitalize the area. A map is attached for your review. Also,by acquiring the abandoned properties, the City would ensure that they are demolished. Due to a lack of funds, the School District cannot afford to demolish the structures. As a result, the structures would remain eyesores in these neighborhoods as well as present future safety hazards. The City has an opportunity to revitalize four areas of town, including the redevelopment of three neighborhoods. This item is scheduled for discussion at the March 5, 1996 City Council meeting.
