HomeMy WebLinkAboutORD 04-045 ORDINANCE NO. 04-045 ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW AN INDOOR SHOOTING RANGE AND RETAIL STORE IN A GC-MD-2 (GENERAL COMMERCIAL-MULTIPLE FAMILY DWELLING-2)DISTRICT LOCATED APPROXIMATELY 1,000 FEET SOUTH OF THE SOUTHEAST CORNER OF MAJOR DRIVE AND THE FOLSOM EXTENSION IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. WHEREAS, the City Council for the City of Beaumont desires to issue a specific use permit to RCSS Properties, Ltd. to allow an indoor shooting range and retail store in a GC-MD-2 (General Commercial-Multiple Family Dwelling-2) District located approximately 1,000 feet south of the southeast corner of Major Drive and the Folsom Extension, being the easternmost 100 feet of that certain 2.09 acre tract out of the Hezekiah Williams Survey, Abstract 56, Jefferson County, Texas, and being out of a 209.2045 acre tract described in Clerk's File#2000047669 of the Jefferson County Real Property Records; said 2.09 acre tract being more particularly described by metes and bounds as described in Exhibit "A' attached hereto; and, WHEREAS, the City Council is of the opinion that the issuance of such specific use permit is in the best interest of the City of Beaumont and its citizens, subject to the hereinafter described conditions; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That a specific use permit to allow an indoor shooting range and retail store in a GC-MD-2(General Commercial-Multiple Family Dwelling-2)District located approximately 1,000 feet south of the southeast corner of Major Drive and the Folsom Extension, being the easternmost 100 feet of that certain 2.09 acre tract out of the Hezekiah Williams Survey, Abstract 56, Jefferson County, Texas, and being out of a 209.2045 acre tract described in Clerk's File #2000047669 of the Jefferson County Real Property Records; said 2.09 acre tract being more particularly described by metes and bounds, as shown on Exhibit "B" attached hereto, is hereby granted to RCSS Properties, Ltd., its legal representatives, successors and assigns, subject to the following conditions: 1. Provide an 8' tall wood screening fence and a minimum 10' landscape strip within a 20' buffer area along the east property line; 2. Provide a 6' wide landscape strip along the parking lot frontage; and, 3. Modify the landscaping/screening requirements along the south property line. Section 2. That the specific use permit herein granted is expressly issued for and in accordance with each particular and detail of the site plan attached hereto as Exhibit"C" and made a part hereof for all purposes. Section 3. Notwithstanding the site plan attached hereto, the use of the property herein above described shall be in all other respects subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. PASSED BY THE CITY COUNCIL of the City of Beaumont this the 29th day of J June, 2004. - Mayor Pro Tem Becky Ames - u � : LEGAL DESCRIPTION FOR ORDINANCE PURPOSES Being the easternmost 100 feet of that certain 2.09 acre tract out of the Hezekiah Williams Survey, Abstract 56, Jefferson County, Texas, and being out of a 209.2045 acre tract described in Clerk's File#2000047669 of the Jefferson County Real Property Records; said 109 acre tract being more particularly described by metes and bounds as follows: BEGINNING at a 1/2" iron rod found for the southwest corner of Lot 11, Block 1 of Fairfield, Phase I, a subdivision in Jefferson County, Texas, recorded in Volume 17, Page 256 of the Jefferson Count} Map Records; said iron rod being the southeast comer of the said 2.09 acre tract and being the POINT OF BEGINNING; THENCE South 87'14'18" West (called South 87'12'22" West) along the north line of a called 8.86 acre tract conveyed to the Mid-County Teachers Credit Union as described in Clerk's File #2001014809 of the Jefferson County Real Property Records, a distance of 455.04 feet(called 455.00 feet)to a 3/8" iron rod set on the east line of Major Drive for the southwest corner of the said 2.09 acre tract; THENCE North 02 053'10" West(reference bearing) along the said east line of Major Drive, a distance of 200.00 feet to a 3/8" iron rod set for the northwest corner of the said 2.09 acre tract; THENCE North 87014'18" East, a distance of 455.04 feet to a 3/8" iron rod set on the west line of said Block 1 and being the northeast corner of the said 2.09 acre tract; THENCE South 02°53'14" East(called South 02°53'10" East) along the west line of said Block 1, a distance of 61.99 feet to a 1/2" iron rod found for the southwest comer of Lot 9 of said Block 1 of Fairfield, Phase 1; THENCE South 02°47'45" East (called South 02°53'10" East)along the west line of Lot 10 of said Block 1, a distance of 67.02 feet(called 67.00 feet) to a 1/2" iron rod found for the southwest comer of said Lot 10; THENCE South 02°58'13" East (called South 02°53'10" East) along the west line of said Lot 11, a distance of 70.99 feet (called 71.00 feet)to the POINT OF BEGIN'_'ING and containing 2.09 acres of land,more or less.
