Patterson May 18, 2004 Audwin Samuel Lane Nichols, City Attorney Kyle Hayes, City Manager Rose Ann Jones, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on May 18, 2004, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items 1-4/Consent Agenda Consent Agenda Mayor Lord called the council meeting to order at 1:30 p.m. Pastor Gloria Harder of the Church of Alpha and Omega gave the invocation. Councilmember Beaulieu led the Pledge of Allegiance. Roll call was made by Betty Braxton, Deputy City Clerk. Present at the meeting were Mayor Lord, Mayor Pro Tem Ames, Councilmembers Smith (arrived at 1:33 p.m. after roll call had been taken)Beaulieu, Cokinos, Samuel and Patterson. Also present were Kyle Hayes, City Manager; Lane Nichols, City Attorney; Betty Braxton, Deputy City Clerk. Mayor Lord announced that Item F on the Consent Agenda had been withdrawn; Persons may speak on Business Items 1-4/Consent Agenda with the exception of Item F. Proclamations, Presentations, Recognitions 1. Hurricane Awareness Week- Proclamation was read by Mayor Lord declaring May 16 - 22, 2004 as "Hurricane Awareness Week"; accepted by Mickey Bertrand 2. National Foster Care Month - Proclamation was read by Councilmember Patterson declaring May 2004 as "National Foster Care Month"; accepting copies of the proclamation was Michelle Harris, Director of Buckner Children and Family Services along with members from Buckner, Therapeutic Family Life and Texas Department of Protective and Family Services 3. National Public Works Week - Proclamation was read by Mayor Pro Tern Ames declaring May 16 - 22, 2004 as "Public Works Week"; accepted by Tom Warner, Public Works Director Minutes-May 18,2004 4. National Transportation Week - Proclamation was read by Mayor Lord declaring May 16 - 22, 2004 as "National Transportation Week"; accepted by Mike Standley Public Comment: Persons may speak on scheduled agenda items No. 1-4/ Consent Agenda. None CONSENT AGENDA Approval of minutes - Minutes of May 4, 2004 Confirmation of committee appointments - None A) Authorize the City Manager to execute the Vacation of a Utility Easement- Resolution 04- 103 B) Authorize the acceptance of two (2) ten foot (10') wide Sanitary Sewer Easements along State Highway 105 at Major Drive to serve the new Jack in the Box Restaurant-Resolution 04-104 C) Authorize the acceptance of two (2) drainage easements off of Twenty-Fourth Street Resolution 04-105 D) Authorize the City Manager to execute a Supplemental Utility Agreement related to the FM 364 Major Drive Improvement Project -Resolution 04-106 E) Authorize the acceptance of two(2)waterline easements for Christus St. Elizabeth Hospital - Resolution 04-107 F) Authorize the allocation of $10,000 from 2003 HOME funds to Stone Way Limited Partnership to assist with architectural and engineering costs associated with the construction of a 104-unit apartment complex at 1650 East Lucas Drive - Withdrawn as stated by Mayor Lord G) Approve the purchase of twelve (12) mobile video systems to be used by the Police Department - Resolution 04-108 Councilmember Cokinos moved to approve the Consent Agenda with the exception of Item F. Mayor Pro Tern Ames seconded the motion. AYES: MAYOR LORD, MAYOR PRO TEM AMES, COUNCILMEMBERS SMITH, BEAULIEU, SAMUEL AND PATTERSON NAYS: NONE MOTION PASSED Page 2 of 7 Minutes-May 18,2004 GENERAL BUSINESS 1) Consider approving a request for the abandonment of two 10' x 214.44' utility easements along the east and west sides of Blackmon Lane Professional Plaza, a 27' private street- Ordinance 04-031 Administration recommended approval of a request for the abandonment of the two utility easements. This property was originally platted with four lots served by a private street. One building was built on Lot 1. It is now the desire of the property owner to construct a building across the north end of the property,thus necessitating the abandonment of the utility easements. At a Regular Meeting held January 26, 2004, the Planning Commission voted 7:0 to approve the request subject to the property owner rectifying the water and sewer services to the satisfaction of the Water Utilities Division. Councilmember Cokinos moved TO APPROVE ORDINANCE 04-031 TO CONSIDER APPROVINGA REQUEST FOR THE ABANDONMENT OF TWO 1 O'x 214.44'UTILITY EASEMENTS ALONG THE EAST AND WEST SIDES OF BLACKMON LANE PROFESSIONAL PLAZA, A 27' PRIVATE STREET. Councilmember Beaulieu seconded the motion. AYES: MAYOR LORD, MAYOR PRO TEM AMES, COUNCILMEMBERS SMITH, BEAULIEU, COKINOS, SAMUEL AND PATTERSON NAYS: NONE MOTION PASSED 2) Consider approving a contract for an addition to and refurbishing of the Lab Building at the Wastewater Treatment Plant - Resolution 04-109 Administration recommended approval of a contract with Place, Ltd., of Lumberton, in the amount of$272,837.89 to furnish and install a new pre-engineered metal lab building, relocate and reconnect equipmentfrom existing lab building to the newone, refurbish the existing lab building. The existing lab building at the wastewater treatment plant was built in 1971 and has deteriorated and no longer meets the Texas Commission on Environmental Quality requirements. Funds for the project are available in the Capital Improvement Fund. Councilmember Smith moved to APPROVE RESOLUTION 04-109 TO CONSIDER APPROVING A CONTRACT FOR AN ADDITION TO AND REFURBISHING OF THE LAB BUILDING AT THE WASTEWATER TREATMENT PLANT. Councilmember Beaulieu seconded motion. Page 3 of 7 Minutes-May 18,2004 AYES: MAYOR LORD, MAYOR PRO TEM AMES, COUNCILMEMBERS SMITH, BEAULIEU, COKINOS, SAMUEL AND PATTERSON NAYS: NONE MOTION PASSED 3) Consider approving a bid for the purchase and installation of one (1) belt filter press for use in the Water Reclamation Plant - Resolution 04-110 Administration recommended the award of a bid for the purchase and installation of one (1) belt filter press in the amount of $202,233.00 to Textile Engineering of Humble, Texas. The belt filter press specified in the bid will be installed at the Water Reclamation Plant to process and dispose of biosolids. Initially, the new unit will primarily handle the accumulated sludge being removed from the two (2) 15 acre aeration ponds at the plant. Thereafter, this unit will be used in conjunction with two (2) smaller units purchased and installed in 2000 and 2001. Three (3) presses will more efficiently handle normal biosilid loads and will minimize wear on the machines. The installation is to be completed within 65 days. Funds are available in the Water Utilities Fund. Councilmember Beaulieu moved to APPROVE RESOLUTION 04-110 TO CONSIDER APPROVING A BID FOR THE PURCHASE AND INSTALLATION OF ONE (1) BELT FILTER PRESS FOR USE IN THE WATER RECLAMATION PLANT. Council member Smith seconded motion. AYES: MAYOR LORD, MAYOR PRO TEM AMES, COUNCILMEMBERS SMITH, BEAULIEU, COKINOS, SAMUEL AND PATTERSON NAYS: NONE MOTION PASSED 4) Consider authorizing the City Manager to increase the Barscreen Area and Belt Press Conveyor Improvements Project amount for"extra work"-Resolution 04-111 Administration recommended approval of increasing the Project amount by $41,138.00 to install a resistant liner in the pit below the barscreen equipment to cover approximately 3400 square feet of deteriorated concrete surface area in order to minimize additional corrosion. The interior walls of the existing pit were built in the early 1950's and have deteriorated. Funds for the project are available in the Capital Improvement Funds.
