Patterson May 4,2004 Audwin Samuel Lane Nichols, City Attorney Kyle Hayes, City Manager Rose Ann Jones, City Clerk The City Council of the City of Beaumont,Texas,met in a regular session on May 4,2004,at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items 1-2/Consent Agenda Consent Agenda Mayor Lord called the council meeting to order at 1:30 p.m. Reverend Jim Sligerof Woodland Baptist Church gave the invocation. Assistant City Attorney Tyrone Cooper led the Pledge of Allegiance. Roll call was made by Rose Ann Jones, City Clerk. Present atthe meeting were Mayor Lord, Mayor Pro Tem Ames,Councilmembers Smith, Beaulieu, Cokinos, Samuel and Patterson. Also present were Kyle Hayes, City Manager; Tyrone Cooper, Assistant City Attorney; Rose Ann Jones, City Clerk. Proclamations, Presentations, Recognitions 1. All Star Little Dribblers Recognition: Mayor Lord recognized the entire team forwinning the Boys Junior Division National Championship; accepted by team coaches LaTye Hatcher, Dr. Randy Lombardo and the entire youth team 2. Present Honorary Citizen cards to representatives from District 3810 of the Phillippines: Mayor Lord presented honorary Beaumont Citizenship cards to this group who are participating in the Rotary Foundation Group Study Exchange Program 3. Ransom "Duce" Jones Recognition: Recognition read by Mayor Pro Tern Ames congratulating Ransom"Duce"Jones on receiving the Jefferson Award;accepted by Mr. Ransom Jones. Mr. Jones was also selected as the Washington, D.C. representative. Public Comment: Persons may speak on scheduled agenda items No. 1-2/ Consent Agenda. None Minutes-May 4,2004 CONSENT AGENDA Approval of minutes - Minutes of April 27, 2004 Confirmation of committee appointments - None A) Approve the City of Beaumont Investment Policy - Resolution 04-096 B) Accept maintenance of the street, storm sewer,water and sanitary sewer improvements in West Chase Village Subdivision, Section Three - Resolution 04-097 C) Accept maintenance of the street, storm sewer, water and sanitary sewer improvements in West Chase Village Subdivision, Section Five - Resolution 04-098 D) Authorize the acceptance of two(2)water line easements providing access forfire prevention services - Resolution 04-099 E) Approve a resolution supporting the Southeast Texas Coalition forthe Homeless and efforts to eliminate chronic homelessness within ten (10) years - Resolution 04-100 Councilmember Cokinos moved to approve the Consent Agenda. Mayor Pro Tern Ames seconded the motion. AYES: MAYOR LORD, MAYOR PRO TEM AMES, COUNCILMEMBERS SMITH, BEAULIEU, SAMUEL AND PATTERSON NAYS: NONE MOTION PASSED GENERAL BUSINESS 1) Consider authorizing the City Manager to execute an Interlocal Agreement with Jefferson County Drainage District No.6 forthe Gulf Terrace Detention Basin Project- Resolution 04-101 The Drainage District is currently constructing the Gulf Terrace Detention Basin off of Phelan Boulevard west of Westbrook High School. The basin is being constructed to alleviate flooding in the Gulf Terrace Addition which is located south of Phelan and the Union Pacific Railroad tracks. The next phase of the project includes the construction of a storm sewer system from south of the tracks to the new detention basin. The City will participate in the project by providing a maximum of$200,000 toward the cost of the concrete drainage boxes. These drainage boxes will also be used as part of the street drainage system when Phelan Boulevard is widened from Major Drive to Keith Road. The Drainage District's project is anticipated to be completed by May 2005. Funds for this project are available in the Public Works Projects of the Capital Improvement Program. Page 2 of 6 Minutes-May 4,2004 Councilmember Cokinos moved TO APPROVE RESOLUTION 04-101 TO ENTER INTO AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF BEAUMONTAND THE JEFFERSON COUNTY DRAINAGE DISTRICT NO. 6. Councilmember Beaulieu seconded the motion. AYES: MAYOR LORD, MAYOR PRO TEM AMES, COUNCILMEMBERS SMITH, BEAULIEU, COKINOS, SAMUEL AND PATTERSON NAYS: NONE MOTION PASSED 2) Consider approving a contractfor Fletcher Mini Park Improvements-Resolution 04- 102 Administration recommended awarding a contract for the Fletcher Mini Park Improvements to the low bidder, G & G Enterprises of Orange, in the amount of $56,800. The proposed improvements forthe park include the following amenities: playground area with a safetyfall cushion surface,new stage,site drainage,sidewalk repair and/or replacement,an electrical service and drinking fountain.The project is to be completed in fifty calendar days. Funds forthe construction of the proposed improvements are available in the General Improvement Fund of the Capital Improvement Program. Councilmember Samuel moved to APPROVE RESOLUTION 04-102 TO ACCEPT THE CONTRACT FOR THE FLETCHER MINI PARK IMPROVEMENTS WITH G & G ENTERPRISES IN THE AMOUNT OF $56,800. Councilmember Cokinos seconded motion. AYES: MAYOR LORD, MAYOR PRO TEM AMES, COUNCILMEMBERS SMITH, BEAULIEU, COKINOS, SAMUEL AND PATTERSON NAYS: NONE MOTION PASSED 3) PUBLIC HEARING: Dilapidated Structures Public Hearing convened at 1:55 p.m. Public Comments: Austin Ngo 2004 Pennsylvania Beaumont TX 77701 Property# 25: 2012 Pennsylvania Requested additional time to be able to make improvements necessary to prevent demolition of the property Page 3 of 6 Minutes-May 4,2004 Margie Swann 2355 John Street Vidor TX 77662 Property#8 4175 Brandon Agreed that the house was in need of demolition but requested that the garage and other structure on the property not be torn down and that consideration be given to prevent damage to the landscaping of the back yard Robert Preston 1190 Iowa St. Beaumont TX Commented on the notification and availability of substandard housing procedures Public Hearing ended at 2:22 p.m. Consider approval of an ordinance declaring certain dilapidated structures to be public nuisances and ordering their repair or removal by the owners and authorizing the removal of certain other structures whose owners failed to complywith condemnation orders. Ordinance 04-030 Following the Public Hearing,Councilmember Samuel moved to remove the property located at 2012 Pennsylvania from a raze orderto a raze or repair order providing 120 days to make significant progress to that property and on the property located at 4175 Brandon to make sure that the two garage structures and the tree are not touched and to APPROVE ORDINANCE 04-030 WITH THESE CHANGES DECLARING CERTAIN DILAPIDATED STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING REPAIR OR REMOVAL BY THE OWNERS AND AUTHORIZING REMOVAL OF CERTAIN OTHER STRUCTURES WHOSE OWNERS FAILED TO COMPLYWITH CONDEMNATION ORDERS. Council member Beaulieu seconded motion.
