BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BEAUMONT:
THAT the City Manager is hereby authorized to execute an Interlocal Agreement with
Jefferson County Drainage District No. 6 forthe Gulf Terrace Detention Basin Project. The
agreement is substantially in the form attached hereto as Exhibit "A".
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 4th day of May,

INTERLOCAL AGREEMENT
This Interlocal Agreement ("the Agreement") is entered into between the City of
Beaumont, a municipal corporation of Jefferson County, Texas, (herein "City") and
Jefferson County Drainage District No. 6 (herein "DD6"), entities which are authorized to
enter into interlocal agreements in accordance with Section 791.001, et seq., of the
Government Code of the State of Texas (Vernon 1996).
WITNESSETH :
WHEREAS, DD6 has requested City to participate in the cost of the "Gulf Terrace
Detention Basin Project;" and
WHEREAS, the City desires to participate in the construction of this project by the
payment of the maximum amount of$200,000.00; and
WHEREAS, DD6 has agreed to construct this project;
NOW, THEREFORE, THE PARTIES HEREBY AGREE AS FOLLOWS:
1.
Obligations of DD6 shall be as follows:
1. DD6 agrees to construct the Gulf Terrace Detention Basin Project in
accordance with plans and specifications which have been approved by the City of
Beaumont.
2. DD6 agrees to construct this project to completion on or before May, 2005.

II.
The City's obligations shall be as follows:
1. City agrees to pay a maximum of$200,000.00 to DD6 upon request by DD6
toward their expected expenses in excess of$1.6 million.
III.
In connection with this agreement, notification shall be as follows:

IV.
This Agreement may be amended by the mutual agreement of the parties hereto
in writing and any amendment shall be attached to and incorporated into this Agreement.
