Construction of Beaumont decreasing the 2003 Street Rehabilitation Project contract amount by $269,305.80. RECOMMENDATION Administration recommends Council approve Change Order No. 1 decreasing the amount of the 2003 Street Rehabilitation Project contract by $269,305.80. BACKGROUND On April 6, 2004, the City of Beaumont awarded L.D. Construction the contract for the 2003 Street Rehabilitation Project in the amount of$1,758,869.80. The scope of work for the project was reduced in order to meet funding availability. The contractor has agreed to reduce the project amount by $269,305.80 for a new contract amount of$1,489,564. The attached Change Order No. 1 shows the materials affected. BUDGETARY IMPACT This change order will reduce the contract amount by $269,305.80. BACKGROUND The Community Development Advisory Committee and Administration recommendations are attached for your review. BUDGETARY IMPACT The 2004 federal allocation is comprised of$2,126,000 in Community Development Block Grant funds and $837,000 in HOME funds. During the February 10, 2004 Council meeting, Council allocated $100,000 to the Public Services/Public Facilities and Improvements and $85,000 to the Public Services/Emergency Shelter Set-Aside line items. PREVIOUS ACTION Council conducted a Public Hearing to receive public comments and listen to representatives of Public Service agencies who addressed the nature of their proposals on the Public Services and the Public Facilities&Improvements line items ofthe 2004 Annual Action Plan Budget,Tuesday,April 6,2004. RECOMMENDATION Administration recommends award of a six (6) month contract for purchasing lubricants to Tri- Con, Inc. of Beaumont at the unit costs reflected in the attached bid tabulation, with an estimated total expenditure for the contract period of$39,841. BACKGROUND The contract specifies that the successful bidder shall provide approximately 11,000 gallons of various lubricants at fixed unit costs for use by various City departments in maintaining vehicles and equipment. Nine (9) vendors were notified with five (5) submitting bids. The products bid by Tri-Con, Inc. have been utilized previously and meet specifications set forth in the bid. The apparent low bidder, Pumpelly Oil Co., took exception to the specification requiring firm pricing and is thereby considered to be non-responsive. The next low bidder is Kost USA of Baton Rouge, Louisiana. Title 10 of the Texas Government Code allows for reciprocity when comparing bids from Texas vendors with vendors from states which statutorily allow in-state preferences for its vendors. Louisiana allows a 10% preference for vendors providing products assembled, processed, produced or manufactured in Louisiana over vendors from out of state. The rule of reciprocity allows Texas municipalities to compare bids between a Texas and Louisiana vendor with a 10% preference for the in-state vendor. Application of this rule would result in an award to Tri-Con, Inc. Duplant, Finance Officer MEETING DATE: April 13, 2004 AGENDA MEMO DATE: April 8, 2004 REQUESTED ACTION: Consider a resolution opposing any school finance or tax system reforms that would negatively affect city revenues and economic development efforts. RECOMMENDATION Administration recommends approval of such resolution. BACKGROUND Governor Perry has proposed a series of reforms designed to achieve"educational excellence"by creating"real and meaningful" relief from municipal property taxes. Included in his proposal is a plan to cap property tax revenue at last year's level plus a growth factor made up of inflation and population growth. Any increase in property tax revenues beyond inflation and population growth would require voter approval. Also included in his proposal are appraisal caps which would limit residential property appraisals to an increase of no more than three percent per year. The current limit is ten percent per year. BUDGETARYIMPACT Unknown but likely to have a significant negative impact on future budgets. PREVIOUS ACTION None SUBSEQUENT ACTION None at this time. RECOMMENDED BY: City Manager and Finance Officer
