WHEREAS, Beaumont Westfield Venture L.P. has agreed to convey a ten foot(10')
wide water line easement, described below and on Exhibit"A"attached hereto, to provide
mandatory access for fire prevention services to the Kroger site on Dowlen Road:
Easement "J" (0.015 acres) - 10' wide water line easement out of Tract 1,
Plat RS-4, W. B. Dyches Survey, Abstract 17; extending from the existing
Easement "G" — conveyed December 17, 2002, with the authority of
Resolution No. 02-296;
and,
WHEREAS, the City Council has considered the donation of said property rights
and is of the opinion that the donation is necessary and desirable and that same should
be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the above-described easement donated by Beaumont Westfield Venture L.P. to
provide mandatory access for fire prevention services to the Kroger site on Dowlen Road
is hereby accepted.
