BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to enter into an agreement with
Entergy-Gulf States Utilities for the installation of underground electrical distribution
facilities at Collier's Ferry Park. The agreement is substantially in the form attached hereto
as Exhibit "A".

COLLIER FERRY PARK
PROJECT AGREEMENT
CITY OF BEAU MONT/ENTERGY-GULF STATES UTILITIES
This agreement is made this day of 1995 by and between the City of Beaumont, a municipal
corporation of the State of Texas, (hereinafter referred to as City)and Entergy-Gulf States Utilities,a company
authorized to do business in the State of Texas,(hereinafter referred to as Gulf States Utilities or G.S.U.).
A .ENTERGY GULF STATES UTILITIES COMMITMENTS:
G.S.U. agrees to provide all labor, equipment and materials necessary to install three phase
underground distribution facilities to replace the existing three phase overhead facilities and to
remove any single Phase overhead facilities that are located within the proposed Collier Ferry
Park. All overhead facilities will be removed except for two transformer banks their poles and
(1) one dip pole. G.S.U. will remove all overhead facilities as they become redundant and
subject to the outcome of the City's litigation with certain residential customer(s) south of the
water pumping station will either remove or leave in place the single phase line that serves
those customers. When this line is no longer needed it will be removed by G.S.U.
B. CITY OF BEAUMONT COMMITMENT
The City of Beaumont agrees to pay for all of the costs associated with this conversion project.
The City also agrees to pay G.S.U. for all costs of this job when all of the three phase
underground facilities are installed and the overhead facilities removed, even if the single
phase tap, providing service to certain residential customers south of the water pumping station
is required to stay in service, pending the outcome of your litigation with these customers.
In consideration for the removal of all overhead facilities(single phase and three phase)except for 2 transformer banks,
their poles and one(1)dip pole and replacing these facilities with underground facilities,the City agrees to pay G.S.U.
$66,192.56. This amount will be paid upon completion of the total job or if litigation requires the single phase tap to
remain in place this amount will be paid upon completion of the three phase segment of this job. The single phase tap
will be removed when it is no longer needed.
