WHEREAS, Jimmy D. Zachary and Peggy J. Zachary have requested that the City
of Beaumont grant a License to Encroach for a portion of a ten (10) foot utility easement
on Lot 13, Block 35 of Dowlen West Addition, Unit XXI for a swimming pool which is
encroaching 3.0 feet for a distance of 20.0 feet, a pool deck is encroaching 7.2 feet for a
distance of 32.0 feet, a metal storage building on skids is encroaching 3.5 feet for a distance
of 12.0 feet into the same easement, as shown in Exhibit "A" attached hereto and made a
part hereof for all purposes; and,
WHEREAS, it appears that it would be equitable to allow such encroachment at this
time;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to execute a Licenses to Encroach
with Jimmy D. Zachary and Peggy J. Zachary for a swimming pool which is encroaching 3.0
feet for a distance of 20.0 feet, a pool deck is encroaching 7.2 feet for a distance of 32.0 feet,
a metal storage building on skids is encroaching 3.5 feet for a distance of 12.0 feet into the
same ten foot utility easement on Lot 13, Block 35 of Dowlen West Addition, Unit XXI as
shown Exhibit "A" attached hereto and made a part hereof for all purposes.
