WHEREAS, Gregg J. and Angela C. Busceme have requested the City of Beaumont
to allow them to encroach on a portion of a ten (10) foot utility easement on Lot 13, and
the South 1/2 of Lot 12, Block 9, and 1/2 of the adjacent alley, Ogden Addition (2110
Victoria) for a garage encroaching 10.8 feet for a distance of 24.2 feet into an abandoned
alley as depicted on Exhibit "A" attached hereto and made a part hereof for all purposes;
and,
WHEREAS, City staff has expended considerable time and effort in investigating the
effect of such encroachment upon the City and utilities serving the same; and,
WHEREAS, it appears that it would be equitable to allow such encroachment at this
time;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager is hereby authorized to execute a License to Encroach to
Gregg J. and Angela C. Busceme for a garage which is encroaching 10.8 feet for a distance
of 24.2 feet into a ten (10) foot utility easement on Lot 13, and the South 1/2 of Lot 12,
Block 9, and 1/2 of the adjacent alley, Ogden Addition (2110 Victoria), as shown on Exhibit
"A" attached hereto, for a one-time fee of Five Hundred Dollars ($500.00).
