WHEREAS, Exxon Company, U.S.A. has requested the City of Beaumont to allow
it to encroach into the Avenue A right-of-way adjacent to Lot 26, Block 14 of the Arlington
Addition for an area of nine square feet 96.0 feet from the north right-of-way line of Euclid
Avenue and 8.0 feet from the east right-of-way line of Avenue A for a groundwater
monitoring well to track concentrations of various pollutants as depicted on Exhibit "A"
attached hereto and made a part hereof for all purposes; and,
WHEREAS City staff has expended considerable time and effort in investigating the
effect of such encroachment upon the City and utilities serving the same; and,
WHEREAS, it appears that it would be equitable to allow such encroachment at this
time;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager is hereby authorized to execute a License to Encroach to
Exxon Company, U.S.A. for a groundwater monitoring well which is encroaching into the
Avenue A right-of-way adjacent to Lot 26, Block 14 of the Arlington Addition for an area
of nine square feet 96.0 feet from the north right-of-way line of Euclid Avenue and 8.0 feet
from the east right-of-way line of Avenue A, as shown on Exhibit "A" attached hereto, for
a one-time fee of Five Hundred Dollars ($500.00).
