ENTITLED AN ORDINANCE DECLARING THE
STRUCTURE AT 2356 POPE STREET IN THE CITY
OF BEAUMONT, JEFFERSON COUNTY, TEXAS TO
BE AN IMMINENT PUBLIC HEALTH HAZARD AND
ORDERING ITS DEMOLITION BY THE CITY OF
BEAUMONT; PROVIDING FOR SEVERABILITY AND
PROVIDING FOR REPEAL.
WHEREAS Section 217.042 of the Local Government Code of the State of Texas
provides that a municipality may enforce all ordinances necessary to prevent and
summarily abate and remove a nuisance; and,
WHEREAS , there exists a structure at 2356 Pope Street that had been declared
by the health authority of the City of Beaumont to be an imminent public health hazard and
a public nuisance; and,
WHEREAS it is recommended that the city council hear evidence concerning the
condition of the structure to declare it to be an imminent public health hazard and public
nuisance and order it to be demolished by the city;
NOW, THEREFORE, BE IT ORDAINED
BY THE CITY OF BEAUMONT:
Section 1.
THAT the City Council of the City of Beaumont has heard evidence concerning the
condition of the structure at 2356 Pope Street and agrees with the health authority that the
structure is an imminent public health hazard and a public nuisance to the citizens of the
City of Beaumont and that public safety requires that this nuisance be abated by whatever
means necessary up to and including the demolition of this structure.
Section 2.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end the various portions and provisions of this ordinance are
declared to be severable.
Section 3.
That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
