HomeMy WebLinkAboutRES 93-092 I (/ RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be and he is hereby authorized to execute a Correction Deed from the City of Beaumont to Loving Acres, Inc. for Lot 10, Block 13 of the Calder Addition to clear title to the property and attached hereto as Exhibit "A". PASSED BY THE CITY COUNCIL of the City of Beaumont this the o2 7,zk day of "J , 1993. - Mayor - THE STATE OF TEXAS § COUNTY OF JEFFERSON § CORRECTION DEED WHEREAS,by conveyance dated 1/8/93, Cloverleaf,Inc. conveyed to the City of Beaumont, Texas, the property hereinafter described as set forth in Film Code # 104-62- 0313 in the office of the County Clerk of Jefferson County, Texas; and, WHEREAS, the City of Beaumont, Texas, has declined to accept such a conveyance and has demanded it be rescinded or corrected to show the actual, intended Grantee; and, WHEREAS, the actual, intended Grantee is Loving Acres, Inc., as set forth in conveyance in Film Code No. 104-70-1371 in the office of the County Clerk of Jefferson } County, Texas, which was given to correct the former conveyance, but did not specifically so state: NOW, THEREFORE, this conveyance is given to correct the record insofar as title to the hereinafter described property is concerned: Date: April , 1993 • GRANTOR: CLOVERLEAF, INC., a Texas Corporation GRANTEE: LOVING ACRES, INC., a Texas Corporation Grantee's Mailing Address (including County): 14425 IH 10 E Orange, TX 77630 Orange County, Texas Consideration: Ten Dollars ($10.00) and other good and valuable consideration. Reservations from and Exceptions to Conveyance and Warranty: All restrictions, reservations and easements of record affecting said property. Grantor, for the consideration and subject to the reservations from and exceptions to conveyance and warranty,grants,sells, and conveys to Grantee the property, together with all and singular the rights and appurtenances thereto in any wise belonging, to have and hold it to Grantee, Grantee's heirs, executors, administrators, successors, or assigns forever. Grantor binds Grantor and Grantor's heirs, executors, administrators, and successors to warrant and forever defend all and singular the property to Grantee and Grantee's heirs, executors, administrators, successors and assigns against every person whomsoever lawfully claiming or to claim the same or any part thereof, except as to the reservations from and exceptions to conveyance and warranty. The City of Beaumont, Texas, joins in this instrument for the purposes of acknowledging that it never intended to, nor ever accepted title to the above described property, and to acquiesce in this correction instrument When the context requires, singular nouns and pronouns include the plural.
