RESOLUTION
WHEREAS, the Clean Air Act Amendments of 1990 require the enforcement of
onerous and stringent offset requirements on the State of Texas in ozone non-attainment
areas; and,
WHEREAS, the Texas Air Control Board, to address the obstacles raised by offset
requirements to economic development in ozone non-attainment areas of the State,working
with a cross section of persons throughout the state, have devised a "draft" bill for
introduction to the Texas Legislature to create a community bank of emission credits for
offsetting industry growth in ozone non-attainment pollution areas such as the Beaumont-
Port Arthur-Orange areas; and,
WHEREAS, the Community Banking concept legislation is intended to address
difficult problems encountered by economic development groups and local political
jurisdictions in ozone non-attainment areas of the State of Texas; and,
WHEREAS, the draft legislation would allow the creation of an "area emission
reduction credit organization" in each Texas ozone non-attainment area - Beaumont-Port
Arthur-Orange, Dallas-Fort Worth, El Paso and Houston-Galveston - initiated by their
Regional Planning Commissions:
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
That the City of Beaumont strongly urge the Texas Legislature to adopt the Community
Emissions Reduction credit Banking bill to promote the coexistence of the improvement of
air quality and continued economic development in ozone non-attainment areas of the State;

and, BE IT FURTHER RESOLVED that the City of Beaumont compliment the Texas Air
Control Board for developing a model to bank the emission credits in addressing the
mandate of the Clean Air Act Amendments of 1990; and,
BE IT FURTHER RESOLVED that the City of Beaumont will work diligently with the
Texas Air Control Board to implement the provisions of the Community Emission Credit
Banking Legislation to help maintain the economic expansion potential for new industries
to locate in our South East Texas Region.
