RESOLUTION
WHEREAS, on September 29, 1992, the City Council authorized the City Manager to
execute Change Order No. 3 and release final payment for the 1991 Street Rehabilitation
Program - Reconstruction and Overlay to BO-MAC Contractions, Inc.; and,
WHEREAS, during the preparation of the final payment, it was determined there was
an error in Change Order No. 3; and,
WHEREAS, included in Change Order No. 3 was the milling on College from Goliad
to 4th, the inclusion of Thomas Road and the change to reflect quantities actually used in the
construction of this project; and,
WHEREAS, the inclusion of Thomas Road was approved in Change Order No. 2;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the action taken in Resolution No. 92-273 be, and it is hereby rescinded.
BE IT FURTHER RESOLVED that the City Manager be, and he is hereby authorized to
execute Change Order No. 3 in the amount of $15,769.44 and to release final payment in the
amount of $130,741.87 to BO-MAC Contractors, Inc. The total amount of this project is
$2,116,100.39.
