RESOLUTION
WHEREAS in October, 1991, City Council awarded a contract to Watkins
Company for Phase II of Riverfront Park in the amount of $380,996.00 with change orders
resulting in a net decrease of $29,327.97 for a final contract cost of $351,668.03; and,
WHEREAS, Watkins Company has submitted a request for release of the final
payment or the 5% retainage of $17,821.00; and,
WHEREAS, due to extensions of time of completion due to delays, liquidated
damages in the amount of $1,400.00 is to be deducted from the final payment;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be, and he is hereby, authorized to accept the project and make
final payment to Watkins Company for Phase II of Riverfront Park in the amount of
$16,421.00.
