Box 3827 Beaumont, Texas 77707 Re: MWPP Order for Information Docket No. VI-91-2758 NPDES Permit No. TX0046990 Dear Mr. Webb: The Environmental Protection Agency (EPA) Region 6 is initiating a program to promote Municipal Water Pollution Prevention (MWPP) . This program is designed to encourage municipal wastewater facilities to provide compliance maintenance prior to becoming noncompliant. Enclosed is an Order for Information that is necessary to implement the MWPP program. The enclosed Order requires an annual environmental audit of your wastewater facilities until the requirement for an annual environmental audit can be addressed in the next reissuance of your National Pollutant Discharge Elimination System (NPDES) permit. Attached to the enclosed Order is an example of the type of information that will be required in the environmental audit report. We have scheduled workshops designed to assist you and answer questions concerning the program and the requested information. These EPA sponsored workshops are being held at different locations throughout Texas. Please refer to Attachment 1 of the Order for the workshop you have been scheduled to attend. This workshop is intended for persons responsible for the funding, operation and NPDES permit compliance of Publicly Owned Treatment Works (POTW) . We recommend that a member of your governing body, your chief operator, and other persons who will be involved in the preparation of the required report attend the workshop. Although your attendance is not mandatory, if you want to know the details of how the MWPP program can help your POTW, you should plan to attend. To assist us in planning these workshops , please contact Ms. Astrid Pool at (214) 655-6475 on or before October 1, 1991, to indicate who will accompany you to the upcoming workshop. -2- Compliance with the provisions of the Order is expected within the timeframe established in the Order. TX0046990 The following FINDINGS are made and Order issued pursuant to the authority vested in the Administrator of the Environmental Protection Agency (EPA) by the above referenced statute (hereinafter the Act) and duly delegated to the Regional Administrator, Region 6, and duly redelegated to the undersigned Director, Water Management Division , Region 6. I. The city of Beaumont (hereinafter referred to as the "Permittee") is a municipality in the State of Texas, located in Jefferson County, the mailing address for which is P.O. Box 3827 , Beaumont, Texas 77707. II. Pursuant to the authority of Section 402(a)(1) of the Act, 33 U.S.C. § 1342, Region 6 issued National Pollutant Discharge Elimination System (NPDES) Permit No. TX0046990 to the Permittee on September 28, 1990, with an effective date of November 6, 1990. The permit authorizes the discharge of specified qualities and quantities of effluent to receiving waters named Drainage Ditch 107; thence to Hillebrandt Bayou; thence into Taylor Bayou in Segment No. 0701 of the Neches-Trinity Coastal Basin. Docket No. VI-91-2758 Page 2 Section 308(a) of the Act, 33 U.S.C. § 1318(a) provides that : Whenever required to carry out the objective of this Act, including but not limited to . . . determining whether any person is in violation of any . .. limitation, prohibition . . . or standard of performance . . . the Administrator shall require the owner or operator of any point source to . . . provide such other information as he may reasonably require. . . . III FINDINGS OF FACT Part III.B.2. of the permit requires the Permittee to take all reasonable steps to minimize or prevent any discharge in violation of this permit which has a reasonable likelihood of adversely affecting human health or the environment. It is EPA's policy to promote pollution prevention wherever possible. To accomplish this goal in the area of domestic waste treatment, EPA is initiating the Municipal Water Pollution Prevention (MWPP) program. This MWPP program includes preventing wastewater permit violations; maximizing the useful lives of Publicly Owned Treatment Works (POTW) through effective operation and maintenance, financial management and reduced wastewater flows and loadings ; and ensuring timely planning and financing for future needs and growth prior to the occurrence of wastewater permit violations. ORDER Based on the foregoing FINDINGS and pursuant to the authority vested in the Administrator under Section 308 (a) (4) (A) of the Act 33 U.S.C . § 1318(a) (4) (A) , and Section 309(a) (3) of the Act, 33 U.S.C. § 1319(a) (3) , Docket No. VI-91-2758 Page 3 and duly delegated to the Regional Administrator, Region 6, and duly redelegated to the undersigned Director, Water Management Division, Region 6, it is ordered: A. That the Permittee, by October 1, 1992, shall submit the information outlined in the attached environmental audit (Attachment 2) to EPA and a copy to the Texas Water Commission (TWC) . This environmental audit shall be signed by a duly authorized representative of the POTW. The reporting period shall cover July 1, 1991, through June 30, 1992. B. That the Permittee shall submit a resolution from the POTW's governing body to EPA and a copy to the TWC. This resolution shall accompany the environmental audit and shall include the information found in Attachment 3. C. That the Permittee shall submit an updated environmental audit and accompanying resolution each subsequent year on October 1. The report shall cover the previous twelve month period from July 1 through June 30. Section 309 of the Act, as amended by the Water Quality Act of 1987 , provides civil and criminal penalties for failure to submit information required under Section 308 and criminal penalties for knowingly making a false statement under Section 308. Section J An SSES was performed on the City's sanitary sewer system in 1978 as part of the E.P.A. Construction Grants Program. The results of the study indicated that infiltration was not a significant problem. Inflow was the major problem due to the age, pipe material, and cross connections with the storm sewer system. The approved Facility Plan provided for "Transport and Treatment" as the most economical solution. The STP was modified to accept 120 MGD of storm water and the collection system was improved to transport the stormwater. The collection system was also repaired by various methods-slip lining, point repairs, and chemical grouting, to exclude stormwater. The improvements were completed in 1989 and very few problems were observed until January 1991 when unusually high rainfall was experienced. Most of the rainfall was contained in the system, but it caused many residences to be without service for over 24 hours on numerous occasions. The City is currently improving the STP to meet the State's new stream standards. The improvements will allow for the continued practice of transporting and treating stormwater. The City's consultant is also developing plans for improvements to existing lift stations and major interceptors that receive large amounts of inflow. New construction is closely inspected and all lines must pass an infiltration test. Page 26A PART 10: SUBJECTIVE EVALUATION A.
