WHEREAS, on September 3, 1991, the City Council of the City of Beaumont awarded
a contract in the amount of $478,936.22 to RSR Road Surface Recycling (USA), Inc. for the
resurfacing of eleven (11) street sections throughout the City; and,
WHEREAS, on March 3, 1991, Change Order No. 1 was executed decreasing the
contract amount by $7,000.00 because of aesthetic deficiencies on some roadways; and,
WHEREAS, Change Order No. 2 has been created to decrease the contract amount by
$69,991.14. This change order is necessary to both decrease and increase the estimated Bid
Quantities, to reflect quantities actually used in construction;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be, and he is hereby authorized to execute Change Order No. 2,
decreasing the contract amount by $69,991.14 to RSR Road Surface Recycling (USA), Inc. and
that in accordance with the terms of the contract the job is hereby accepted and final payment
in the amount of$20,097.35 is authorized to be paid to BO-MAC Construction as requested in
writing by RSR Road Surface Recycling (USA), Inc. as compensation for materials supplied to
RSR by BO-MAC Construction.
