HomeMy WebLinkAboutRES 92-065 7C-- 9a -6_5- RESOLUTION WHEREAS, the City Council of the City of Beaumont deems it necessary to participate in the Meentzen Drainage Project with Drainage District#6 to relieve drainage Ditch 904; and, WHEREAS, said City Council deems it necessary to acquire the hereinafter described interests in and to the hereinafter described property for the Meentzen Drainage Project, and has found and determined that said interests in and to the hereinafter described land is suited for such purposes and that it is necessary to acquire same for said purposes; and, WHEREAS, the City of Beaumont, through its duly authorized representatives, has negotiated in good faith with the owners of the hereinafter described land and has been unable to agree with such owners of such property as to the fair market value thereof and damages, if any; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be, and he is hereby, authorized and directed to file or cause to be filed against all owners of the following parcel of land, being the north one-half of the dedicated Meentzen Road adjacent to Lot 136 for the Meentzen Drainage Project, and all claimants of any interest therein, proceedings in Eminent Domain to acquire fee title for said purposes, in and to the said parcel of land described in Exhibit "A" attached hereto and made a part hereof, the parcel of land being situated in Beaumont, Jefferson County, Texas. SHACKELFORD N � 'Y �f Cad 136 133 134 L33 rstNrar et 137 ( IA 138 1`j► ' 139 140 i u t N � e 1 tt AN EXHIBIT "All MEENTZEN DRAINAGE Parcel No. 3 Being 0.27 acre of land, more or less, and being the North one-half of the street right-of-way adjacent to Lot 136 of the Meentzen Brothers Subdivision, said Lot 136 being described as follows: All that certain Two (2) acre tract, piece or parcel of land lying and being situated in the County of Jefferson, State of Texas, and being out of the West 400 acres of the H. P. Savery one-fourth League Survey, and being known as said Lot 136 of the Meentzen Brothers Subdivision as recorded in Volume 3, Page 229 of the Map Records of Jefferson County, Texas, of said 400 acres, as the South Two (2) acres of Block No. One Hundred and Thirty-Six ( 136 ) , and fully described by metes and bounds as follows: BEGINNING at an iron stake at the S. W. corner of said Block No. 136, said stake being at the intersection of Meentzen Avenue with the public road running North; THENCE East along the North line of Meentzen Avenue, 387.9 feet to a stake for corner, same being the S. E. corner of Block 136 ; THENCE North 225 feet to a stake for corner; THENCE West 387.9 feet to a stake for corner, said stake being along the East line of said public road running North; THENCE South along the said East line of said public road 224 feet to the Place of Beginning, containing two (2) acres of land, more or less, and being the same tract of land conveyed by F. E. Tausch and wife, Audrey Tausch to Floyd (T. F. ) Lane, by Deed dated October 5, 1937, and recorded in Volume 514, Page 39 of the Deed Records of Jefferson County, Texas, on the 2.9th day of June, 1942, to which Deed and the record thereof reference is here made for all purposes.
