WHEREAS, on July 23, 1991, City Council authorized the City Manager to
enter into a contract with Wm. H. Gray Construction Co., Inc. in the amount of
$727,588.00 for the construction of Fannett Road Outfall; and,
WHEREAS, Change Order No. 1 was created to decrease the contract amount
by $13,231.00 to $714,357.00. This change order is necessary to both decrease and
increase estimated Bid Quantities to reflect quantities actually used in construction;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be, and he is hereby, authorized to execute Change Order No. 1
with Wm. H. Gray Construction Company, Inc. for a contract price decrease in the amount
of $13,231.00;
BE IT FURTHER RESOLVED that in accordance with the terms of the
contract, final payment in the amount of $49,319.95 be paid to Wm. H. Gray Construction
Company, Inc.
