BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT:
THAT the City Manager be, and he is hereby, authorized to execute a contract with
Jefferson County Drainage District No. 6, and file the National Pollutant Discharge Elimination
System Agreement. A copy of the NPDES agreement is attached hereto as Exhibit "A".

Il'�ITERLOCAL AGREEMENT
THE STATE OF TEXAS X
COUNTY OF JEFFERSON X
This Contract is made by and between the City of Beaumont, a home
rule City of the State of Texas (hereinafter called "City"), and Jefferson
County Drainage District No. 6, a special district of the State of Texas
(hereinafter called 'District") under authority of the Inter-local Cooperation
Act, Texas Revised Statutes ANN. Article 4413 (32c). The City and the
District agree as follows:
WITNESSETH :
The City and the District agree that it would be mtageous to file
the National Pollutant Discharge Elimination System(NPDES)with the City
being the applicant and the District being the co-applicant.
The City and the District agree to share the total cost of this project
on a 50-50 basis as follows: (The estimated cost is $800,000.00.)
o The City will be responsible for all engineering
services necessary to meet the EPA requirements
set forth in the first rule published November 16,
1990.
o The District will be invited to give input and
review the permit prior to the finalization of
permit application being submitted to the EPA.
Final permit application will be subject to District
approval.

• The City will coordinate and manage the project
and bill the District for its proportionate share of
the cost each month.
• Upon completion and acceptance of the permit
application, the City and District shall share
responsibilities during the permit period.
