HomeMy WebLinkAboutRES 91-122 9/- 1,:2.2- RESOLUTION WHEREAS, when reserve units were called up in the Persian Gulf emergency, the City Council adopted a policy to continue employment benefits for reservists on active duty; and, WHEREAS, this policy, effective for 90 days, provided for active duty reservists to be compensated for the difference between their City wages and their military pay and for continuation of their insurance coverage for dependents on the same basis as when they were actively employed by the City; and, WHEREAS, the City Council desires to extend the benefits to all reservists who served on active duty to a total of 225 days; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT it shall be the policy of the City of Beaumont that all City employees called to active duty in the reserves or National Guard in the Persian Gulf emergency shall be compensated for the difference between their service pay and their salary with the City for a period of 225 calendar days and that insurance coverage for their dependents shall be continued for 225 calendar days on the same basis as when they were actively employed by the City. POLICY• A. It is the policy of the City of Beaumont to work within the framework of both state and federal statutes to assist those regular full time city employees who are reservists and who have been mobilized to serve their country. This assistance will be provided through compensation supplements and insurance extension. This policy is effective retroactively to August 27, 1990. This policy is effective for 90 calendar days for each reservist who is called to active duty during this national emergency (Persian Gulf Crisis) . B. Effective May 28, 1991, this policy is amended to include an additional 135 days for a total of 225 days of supplemental pay for reservists who are called to active duty during this national emergency. II. OBJECTIVE• To define the guidelines which will be applicable to reservists only in the case of a national emergency where the Armed Forces have issued mobilization orders for active duty. III. PROCEDURES/RULES: A. Employees reporting to active duty shall be paid the difference between their civilian and military compensation. B. At no time shall the employee receive from the City and the military, compensation that exceeds his/her usual base salary. C. While on active duty the employee shall not accrue any leave benefits. D. The employee's dependents will be provided medical coverage at no cost (except in situations where an employee is currently contributing for dependent coverage) for the duration of this policy. The employee's coverage shall cease at the time of their mobilization. E. Required premiums for supplemental life, cancer insurance, long term disability or the flexible reimbursement program will continue through payroll deductions for those participating employees. F. Upon return from active duty, the employee shall commence to accrue leave benefits in accordance with personnel policies. G. Any employee who is interested in the military buy- back program for credit in TMRS should contact the Employee Relations Office upon their return to work. H. An employee who is on active duty shall not be permitted to use any accrued vacation, personal leave or compensatory time while this policy is in effect. However, if an employee remains on active duty after the expiration of this policy, he/she may be paid any accrued vacation, personal leave or compensatory time in a lump sum payment. I. After the expiration of this policy, the employee shall be considered as on leave without pay. J. When on leave without pay, payments for items listed in Section E will be required to be paid by the employee in order to maintain those benefits. The premium to be paid by the dependent for medical coverage shall be the lowest of the appropriate established COBRA rates. K. Any employee affected by this policy amendment of May 28, 1991 will receive supplemental pay for each additional day of active duty in excess of the original 90 day supplemental pay limitation. Under no circumstances will an employee receive supplemental pay in excess of the approved 225 days. 2 of 2
