HomeMy WebLinkAboutRES 91-084 RES OLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be, and he is hereby, authorized to execute a new intergovernmental contract between Jefferson County and the City of Beaumont a copy of which is attached hereto as Exhibit "A" and made a part hereof for all purposes. PASSED BY THE CITY COUNCIL of the City of Beaumont this the day of , 1991. - Mayor - i-� =� q/ car THE STATE OF TEXAS COUNTY OF JEFFERSON INTERGOVERNMENTAL,CONTRACT WITNESSETH : WHEREAS,the City of Beaumont has streets,roads,ditches,and recreational areas which require maintenance which, at times, exceeds temporarily the ability of the City of Beaumont to promptly supply; and, WHEREAS, the capacity of Jefferson County to supply maintenance to streets, roads, ditches, and recreational areas, at times, temporarily exceeds its capacity; and, WHEREAS,the County of Jefferson desires to provide fire protection to Cardinal Meadows, Garden Villa, the new Jefferson County Jail and the Texas Department of Corrections Prison on an emergency basis; and, WHEREAS, the parties recognize that cooperation between the governmental agencies will provide better service to the public at reduced expense by avoiding costly duplication of equipment; NOW, THEREFORE, the City of Beaumont and the County of Jefferson hereby agree as follows: 1. On an emergency basis only, the Beaumont Fire Department will respond to fires occurring at Cardinal Meadows, Garden Villa, the new Jefferson County Jail and the Texas Department of Correction Prison by dispatching its firefighting equipment and personnel for secondary fire protection. The installation of water lines and hydrants or any other services not specifically enumerated herein,will not be provided. 2. In consideration of such service, the County, through its Road and Bridge Precinct Numbers 1 and 4, shall furnish labor and equipment for the maintenance, repair, and reconstruction of City streets, roads, ditches, and recreational areas as the County is able to coordinate the services with its ~ own work and scheduling. The City shall be responsible for providing all material. All work will be done according to applicable City standards for the type of work being performed. Requests for street, roads, ditches, and EXHIBIT "A" recreational areas shall be in writing by the City or his designee prior to the beginning of the work. 3. This agreement shall also include the exchange of other services and products as may be agreed upon by and between the City and County. 4. This agreement shall remain in full force and effect until I and from year-to-year thereafter unless terminated by written i notice by either party. In such an event,the contract shall be terminated on of the year following written notification. 5. Neither the City, its agents, employees, firemen, nor any other person operating under this contract shall be deemed an agent or an employee of the County, and the County shall not be liable for the contracts or tortious conduct of any such persons. 6. Neither the County, its agents, employees, nor any other person operating under this contract shall be deemed an agent or an employee of the City and the City shall not be liable for the contracts or tortious conduct of any such persons.
