R E S O L U T I O N
WHEREAS, Don M. Viguet and Margie C. Viguet, owners of
a residence at 7085 Limerick Drive, have requested the City of
Beaumont to allow them to encroach on 3 . 0 feet for a distance of
12 .2 feet into the ten foot (10") utility easement and 1. 0 feet
for a distance of 24.2 feet into a five foot (51 ) street light
easement on the side of Lot 18, Block 35, Dowlen West Unit XXI
Addition as depicted on Exhibit "A", attached; and,
WHEREAS City staff has expended considerable time and
effort in investigating the effect of such encroachment upon the
City and utilities serving the same; and,
WHEREAS, it appears that it would be equitable to allow
such encroachment at this time;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager is hereby authorized to execute a License
to Encroach for Don M. Viguet and Margie C. Viguet, owners, into
3.0 feet for a distance of 12 .2 feet into the ten foot (101 )
Utility easement and 1.0 feet for a distance of 24.2 feet into a
five foot (51 ) street light easement on the side of Lot 18, Block
35, Dowlen West Unit XXI Addition as shown on Exhibit "A"
attached hereto, for a one-time fee of Five Hundred Dollars
($500. 00) .
