HomeMy WebLinkAboutRES 90-093 90- 93 R E S O L U T I O N WHEREAS, the City Council of the City of Beaumont deems it necessary that M. L. King, Jr. Pkwy./Spur 380, in the City of Beaumont, Jefferson County, Texas be located, constructed, widened, extended and maintained; and, WHEREAS, said City Council has found that a public necessity exists requiring the location, construction, widening, extension and maintenance of said street on the hereinafter described property; and, WHEREAS, the City Council deems it necessary to acquire the hereinafter described interests in and to the hereinafter described property for said location, construction, widening, extension and maintenance of said street, and has found and determined that said interests in and to the hereinafter described land is suited for such purposes and that it is necessary to acquire same for said purposes; and, WHEREAS, the City of Beaumont, through its duly authorized representatives, has negotiated in good faith with the owners of the hereinafter described land and has been unable to agree with such owners of such property as to the fair market value thereof and damages, if any; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Attorney be, and he is hereby, authorized and directed to file or cause to be filed against all owners of the following parcels of land, and all claimants of any interest �� -9 3 therein, proceedings in Eminent Domain to acquire fee title for said purposes, in and to the said parcels of land described in Exhibit "A" attached hereto and made a part hereof, the parcel of land being situated in Beaumont, Jefferson County, Texas. PASSED BY THE CITY COUNCIL of the City of Beaumont this the 15 day of _ , 1990. - Mayor - Parcel 403A Part 1 and 2 Being 0.3214 Acres of land, more or less, being all of Lots 1 and 12, Block 12, of the Calder Addition to the City of Beaumont, Jefferson County, Texas acording to a map or plat of said Addition recorded in Volume 2, Page 115, Deed Records of Jefferson County; and being part of the same land described in a deed from The Edson Realty Company to Munroe Dry Cleaning Company, Inc. , dated March 7, 1980, recorded in Volume 2220, Page 4 and in a deed to Munroe Dry Cleaning, Inc. , dated August 11, 1928, recorded in Volume 308, Page 355, Deed Records of Jefferson County, Texas, said 0.3214 acres of land, more or less, being more particularly described in two tracts as follows Tract 1 (Parcel 403A, Part 1) Being 0. 1607 acres of land, more or less, being all of Lot 1, Block 12, of said Calder Addition, same land being part of the same land described in a deed to Munroe Dry Cleaning Company, Inc. , dated August 11, 1928, as recorded in Volume 308, Page 355, Deed Records of Jefferson County, Texas and containing 0. 1607 acres of land, more or less. Tract 2 (Parcel 403A, Part 2) Being 0. 1607 acres of land, more or less, being all of Lot 12, Block 12, of said Calder Addition, same land being part of the same land described in a deed from The Edson Realty Company to Munroe Dry Cleaning Company, Inc . , dated March 7, 1980, as recorded in Volume 2220, Page 46, Deed Records of Jefferson County, Texas and containing 0. 1607 acres of land, more or less. Summary: Tract 1 (Parcel 403A, Part 1) 0.1607 Acres Tract 2 (Parcel 403A, Part 2) 0.1607 Acres Total 0.3214 Acres Title to all of laundry building and attached equipment, building being constructed of brick and metal on a concrete foundation, with said building and equipment being located partially on the remaining property of which the above described property was originally a portion; said building being traversed by the proposed west right of way line of Spur 380, which line enters the south end of said building approximately fifteen feet (15 ft. ) east of the southwest corner of said building and leaves said building approximately five feet (5 ft. ) east of the northwest corner of said building; along with the temporary right to enter upon the property remaining, of which the above described premises was originally a portion , for the sole purpose of removing all of said bisected building and attached equipment.
