R E S O L U T I O N
WHEREAS, Gulf States Utilities Company recently purchased
a tract of land in the Noah Tevis Survey, Abstract 52 that was
formerly the B.S.L. & W. Railroad one hundred foot wide right-of-
way; and,
WHEREAS, in the conveyance of this property, the railroad
sold Gulf States Utilities Company the street right-of-way that the
railroad had occupied; and
WHEREAS, the tract included a portion of the South Street
right-of-way and the Smart Street right-of-way between Eleventh
Street and Oxford Street; and,
WHEREAS, Gulf States Utilities Company wishes to donate
this right-of-way to the City of Beaumont a plat of the property
and a fieldnote description are attached hereto as Exhibit "All;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the donation by Gulf States Utilities Company of 0.138 acre
(South Street) and 0.155 acre (Smart Street) out of the Noah Tevis
Survey, Abstract 52 for the street rights-of-way be accepted by the
City of Beaumont.
PASSED BY THE CITY COUNCIL of the City of Beaumont this

Fieldnote descripti f two (2) tracks of land to be dons by Gulf
States Utilities Con+�nY for street rights-of-way:
TRACT NO. 1:
Being 0.138 acres of land situated in the Noah Tevis
Survey, Abstract No. 52, Jefferson County, Texas, and
being out of and a part of the former B.S.L. & W.
Railroad 100 foot wide right-of-way, said 0.138 acres
being more particularly described as follows:
BEGINNING at an "X" mark set in concrete for corner at
the intersection of the North right-of-way line of South
Street with the West line of said Railroad right-of-way;
THENCE N88 0 42'54"E along and with said North line of
South Street 100 feet to an "X" mark set in concrete for
corner in the East right-of-way line of said Railroad
right-of-way;
THENCE S01 0 33'00"E 60.00 feet along and with said East
right-of-way line of said Railroad right-of-way to an
"X" mark set in concrete for corner in the South
right-of-way line of South Street;,
]"HENCE S88 0 42'54"W 100.00 feet along and with said South
line of South Street to an "X" mark set in concrete for
corner in the West right-of-way line of said Railroad
right-of-way.
THENCE N01'33'00"W 60.00 feet along and with said West
right-of-way line of said Railroad right-of-way to the
PLACE OF BEGINNING and containing 0. 138 acres of land,
more or less.
TRACT NO. 2:
BEING 0.155 acres of land situated in the Noah Tevis
Survey, Abstract No. 52, Jefferson County, Texas and
being out of and apart of the former B.S.L. & W.
Railroad 100 foot wide right-of-way, said 0. 155 acres
being more particularly described as follows:
BEGINNING at an iron rod set for corner at the
intersection of the North line of Smart Street with the
West line of said Railroad right-of-way;
THENCE S89 0 09'29"E 110.24 feet along and with said North
line of Smart Street to an iron rod set for corner in
the East right-of-way of said Railroad right-of-way;
THENCE in a Southeasterly direction along and with the
East line of said Railroad right-of-why, in a curve to
the left having a central angle of 04 38 '25", and a
radius of 845.19 feet 6 an arc length of 68 .45 feet,
(chord bearing of S27 53 '56"E, 68.43 feet) to an iron
rod set for corner in the South right-of-way line of
Smart Street;
THENCE N89009'29"W 114.58 feet along and with the South
right-of-way line of Smart Street to an iron rod set for
corner in the West right-of-way line of said Railroad
right-of-way;
THENCE in a Northwesterly direction along and with the
West line of said Railroad right-of-way, in a ciScular
curve to the right, having a central angle of 04 01 '45",
and a radius of 945.19 9 eet, for an arc length of 66.47'
feet (chord bearing N24 37'06"W, 66.45 feet) to the
PLACE OF BEGINNING and containing 0. 155 acres of land,
