HomeMy WebLinkAboutRES 90-068 m 90 -�� R E S O L U T I O N WHEREAS, the City Council of the City of Beaumont deems it necessary that M. L. King, Jr. Pkwy./Spur 380, in the City of Beaumont, Jefferson County, Texas be located, constructed, widened, extended and maintained; and, WHEREAS, said City Council has found that a public necessity exists requiring the location, construction, widening, extension and maintenance of said street on the hereinafter described property; and, WHEREAS, the City Council deems it necessary to acquire the hereinafter described interests in and to the hereinafter described property for said location, construction, widening, extension and maintenance of said street, and has found and determined that said interests in and to the hereinafter described land is suited for such purposes and that it is necessary to acquire same for said purposes; and, WHEREAS, the City of Beaumont, through its duly authorized representatives, has negotiated in good faith with the owners of the hereinafter described land and has been unable to agree with such owners of such property as to the fair market value thereof and damages, if any; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Attorney be, and he is hereby, authorized and directed to file or cause to be filed against all owners of the following parcels of land, and all claimants of any interest r therein, proceedings in Eminent Domain to acquire fee title for said purposes, in and to the said parcels of land described in Exhibit "A" attached hereto and made a part hereof, the parcel of land being situated in Beaumont, Jefferson County, Texas. ' 4AKLAN EXHIBIT "A" i Spur 380 Parcel 400 Being 0.1385 acres of land, more or less, out of lots 5 b 6 and part of alley closed by City Ordinance, all out of Block 26 of the Calder Addition to the City of Beaumont, Jefferson County, Texas, according to a map or plat of said Addition recorded in Volume 2, Page 115, Deed Records of Jefferson County;'and being part of the same land described in two deeds to Schlett Enterprise, Inc. from James W. Schlott, dated December 31, 1979, as recorded in Volume 2207, Pages 38 and 40, Deed Records of Jefferson County, Texas, said 0.1385 acres of land, more or less, being more particularly described by metes and bounds as follows: Commencing at the northeast corner of said Lot 5, same lying in the south right of way line of Liberty Avenue; Thence South 86'23'16" Test along the north line of Lot 5 and the south right of way line of Liberty Avenue a distance of 50.00 feet to the northeast corner of said Lot 6 for the Point of Beginning; Thence South 3'34144" East along the east line of Lot 6 a distance of 39.02 feet to a point for corner in the proposed east right of way line of Spur 380, said point being the beginning of a 4.722 degree curve to the left having a central angle of 5'33'03", tangent bearing at said point being South 19'59149" East; Thence in a southerly direction with said curve to the left a distance of 117.54 feet to a point for corner in the south line of Lot 5, same being center line of said alley closed by City Ordinance, tangent bearing at said point being South 25'32152" East; Thence South 86'23'16" West along said center line of alley, same being the south line of Lot 5 a distance of 38.63 feet to the southeast corner of said Lot 6; Thenee'North 3'34144" West along the west line of Lot 6 a distance of 70.00 feet to a point for corner in the north line of a tract of land recorded in ,Fils Code no. 100-25-1136 Deed Records of Jefferson County, same point being South 3'34144" East a distance of 80.00 feet from the northeast corner of Lot 6; Thence South 86'23'16" West along said north line. a distance of 50.00 feet to a point for corner in the east line of Lot 6, same point lying in the east right of way line of Mariposa Street; Thence Worth 3'34144" West along said east right of way line of Mariposa Street a distance of 80.00 feet to the northwest corner of said Lot 6; Thence Worth 86'231.16" East along the north line of Lot 6 a distance of 50.00 feet to the Point of Beginning and containing 0.1385 acres of land, more or less.
