Patterson January 27, 2004 Audwin Samuel Lane Nichols, City Attorney Kyle Hayes, City Manager Rose Ann Jones, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on January 27, 2004, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 11:30 a.m. to consider the following: CALL TO ORDER * Roll Call Mayor Lord called the meeting to order at 11:30 a.m. Present at the meeting were Mayor Lord, Mayor Pro Tern Ames, Councilmembers Smith, Beaulieu, Cokinos and Patterson. Also present were Lane Nichols, City Attorney; and Tina Broussard, City Clerk's office. Absent: Councilmember Samuel Mayor Lord read the legal notice of the Executive Session. Council adjourned into Executive Session at 11:32 a.m. Following Executive Session, with no action being taken, Regular Council Meeting was reconvened at 1:30 p.m. OPENING * Invocation Pledge of Allegiance Roll Call * Presentations and Recognition * Public Comment: Persons may speak on scheduled agenda items * Consent Agenda Mayor Lord reconvened the regular council meeting at 1:30 p.m. Rev. Francis Conroy of St. Pius X Catholic Church gave the invocation. City Clerk, Rose Ann Jones led the Pledge of Allegiance. Roll call was made by Rose Ann Jones, City Clerk. Present at the meeting were Mayor Lord, Mayor Pro Tern Ames, Councilmembers Smith, Beaulieu, Cokinos, Samuel and Patterson. Also present were Kyle Hayes, City Manager; Lane Nichols, City Attorney; and Rose Ann Jones, City Clerk. Proclamations, Presentations, Recognitions None Minutes-January 27,2004 Public Comment: Persons may speak on scheduled General Business Agenda Items 1-2/ Consent Agenda. None CONSENT AGENDA * Approval of minutes - Minutes of January 20, 2004 (with a correction on the Consent Agenda, Councilmember Samuel Abstained on Item A instead of Councilmember Patterson) * Confirmation of committee appointments A) Approve a resolution authorizing the City Manager to execute a Utility Joint Use Agreement and a Standard Utility Agreement with, both, Kinder Morgan Texas Pipeline, L.P. and Center Point Energy Entex for the Delaware Street Extension Project - Resolution 04-020 B) Approve a resolution accepting maintenance of the street and storm sewer improvements in Bellechase Section One, Phase Two-B Subdivision - Resolution 04-021 C) Authorize the City Manager to execute a Pay Phone Service Agreement with Southwestern Bell/SBC Public Communications (SBC) - Resolution 04-022 D) Approve a resolution to allow Hibernia National Bank to pledge a collateral for City accounts - Resolution 04-023 Councilmember Smith moved to approve the Consent Agenda. Mayor Pro Tern Ames seconded the motion. AYES: MAYOR LORD, MAYOR PRO TEM AMES, COUNCILMEMBERS SMITH, BEAULIEU, COKINOS, SAMUEL AND PATTERSON NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider approving the purchase of lightbars for the Police Department's patrol vehicles- Resolution 04-024 Administration recommends the purchase of twenty-five (25) Code 3 LED X2100 Police vehicle lightbars from GT Distributors of Austin, Texas for $43,372.50. City Council has previously approved the purchase of twenty-five new Chevrolet Impalas to be used as Police patrol vehicles. These cars will require the installation of emergency Page 2 of 4 Minutes-January 27,2004 Funds are available for the expenditure in the Police Department's Local Law Enforcement Block Grant Fund. Councilmember Cokinos moved TO APPROVE THE PURCHASE OF LIGHTBARS FOR THE POLICE DEPARTMENT'S PATROL VEHICLES. Councilmember Smith seconded. AYES: MAYOR LORD,MAYOR PRO TEM AMES,COUNCILMEMBERS SMITH, COKINOS, BEAULIEU, SAMUEL AND PATTERSON NAYS: NONE MOTION PASSED WORKSESSION Mayor Lord called the Worksession to order at 1:45 p.m. Review and discuss a proposed moratorium on the issuance of permits for the erection or construction of any off-premise signs within the city limits of Beaumont for a period of one hundred-twenty (120) days. Director of Public Works, Tom Warner conducted the workshop. A slide show was presented to illustrate the current signs and billboards throughout the city and their inconsistencies. Currently the sign regulations are not consistent for the districts within the city limits. The general appearance of the city needs to be improved, and a study is in progress to make recommendations regarding the erection and construction of any off- premise signs. These meetings will be made public so that all interested parties can participate. 2. Consider approving a request for a moratorium on the issuance of permits for the erection or construction of any off-premise signs within the city limits of Beaumont for a period of one hundred-twenty (120) days. Ordinance 04-003 Mayor Pro Tern Ames commented that these meetings should be made public so all interested parties may have proper input in the recommendations. With that, Mayor Pro Tern Ames moved to approve ORDINANCE 04-003 APPROVE A MORATORIUM ON THE ISSUANCE OF PERMITS FOR THE ERECTION OR CONSTRUCTION OF ANY OFF-PREMISE SIGNS WITHIN THE CITY LIMITS OF BEAUMONT FOR THE PERIOD OF ONE HUNDRED-TWENTY(120)DAYS. Councilmember Smith seconded the motion.
