HomeMy WebLinkAboutRES 89-174 RESOLUTION WHEREAS, the City Council of the City of Beaumont deems it necessary that M. L. King, Jr. Pkwy./Spur 380, in the City of Beaumont, Jefferson County, Texas be located, constructed, widened, extended and maintained; and, WHEREAS, said City Council has found that a public necessity exists requiring the location, construction, widening, extension and maintenance of said street on the hereinafter described property; and, WHEREAS, the City Council deems it necessary to acquire the hereinafter described interests in and to the hereinafter described property for said location, construction, widening, extension and maintenance of said street, and has found and determined that said interests in and to the hereinafter described land is suited for such purposes and that it is necessary to acquire same for said purposes; and, WHEREAS, the City of Beaumont, through its duly authorized representatives, has negotiated in good faith with the owners of the hereinafter described land and has been unable to agree with such owners of such property as to the fair market value thereof and damages, if any; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Attorney be, and he is hereby, authorized and directed to file or cause to be filed against all owners of the following parcel of land, and all claimants of any interest \- - 7�Z therein, proceedings in Eminent Domain to acquire fee title for said purposes, in and to the said parcel of land described in Exhibit "A' and attached hereto and made a part hereof, the parcel of land being situated in Beaumont, Jefferson County, Texas. PASSED BY THE CITY COUNCIL of the City of Beaumont this the 29 day of August 1989. - Mayor - - 2 - SPUR 380 Parcel 401 Being 0.0095 acres of land, more or less, out of Lot 1, Block 27 of the Calder Addition to the City of Beaumont, Jefferson County, Texas, according to a map or plat of said Addition recorded in Volume 2, Page 115, Deed Records of Jefferson County; and being part of the same land described in a deed from Johnny Dabbs to Billy G. Williford, et ux, dated April 24, 1978, recorded in Volume 2070, Page 414, Deed Records of Jefferson County, Texas, said 0.0095 acres of land, more or less, being more particularly described by metes and bounds as follows: Commencing at the northwest corner of Lot 2, Block 27 of said Calder Addition, same being in the south right of way line of Liberty Avenue; Thence North 86'23'16" East along said south right of way line of Liberty Avenue a distance of 85.65 feet to the proposed west right of way line of Spur 380, same being the Point of Beginning; Thence North 86'23116" East along said south right of way line of Liberty Avenue a distance of 14.35 feet to the northeast corner of said Lot 1, same lying in the west right of way line of Mariposa Street; Thence South 3'34'44" East along said west right of way line of Mariposa Street a distance of 55.84 feet to a point for corner at the beginning of a 4.2975 degree curve to the right, having a central angle of 2'28140", tangent bearing at said point being North 19 14 09 West; Thence is a northwesterly direction along said 4.2975 degree curve to the right a distance of 57.65 feet to the Point of Beginning, tangent bearing at said point being North 16'45129" West, said tract containing 0.0095 acres of land, more or less.
