HomeMy WebLinkAboutRES 89-125 yP d'9_i,2,s R E S O L U T I O N WHEREAS, Resolution 88-178, dated August 30 , 1988, authorized the City Manager to advise the State Department of Highways and Public Transportation that the City of Beaumont has no objection to the disposal of a surplus parcel of FM 364 (Major Drive) right-of-way located at the intersection with Interstate 10 , as described in Exhibit "A11 attached hereto; and, WHEREAS, the land is no longer needed for the use of citizens as a road, nor does it have a potential for park, conservation, recreation or similar purposes; and, WHEREAS, the State of Texas wishes to exchange the said right-of-way as part consideration for the purchase of Parcel No. 411 on the Spur 380 Project; and, WHEREAS, the land on both sides of the surplus right- of-way, as well as Parcel 411 , are owned by Patrick Henry Phelan and Michael Arthur Phelan, Trustees of K. E. Phelan Carmody, J. C. Phelan, M. M. Phelan Green, M. E. Phelan McKaughan, C. A. Phelan McMahon, L. H. Phelan Bean, S. A. Phelan Davant, A. M. Phelan, Jr. , P. H. Phelan, M. A. Phelan, and H. D. Phelan, hereinafter called "Owners" ; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be, and he is hereby, authorized to request the State Department of Highways and Public Transportation to exchange the surplus right-of-way with Owners as part consideration for Parcel 411 on the Spur 380 Project. 1 PASSED BY THE CITY COUNCIL of the City of Beaumont this the 20th day of June 1989.
