WHEREAS, weed abatement liens are on record against several
lots in Cartwright Terrace Addition and Crockett Addition which are
now owned by the Beaumont Bank; and,
WHEREAS, these liens are for abatement of violations which
occurred under a previous ownership before the Beaumont Bank
acquired the property through foreclosure after a bankruptcy and
were in no way the fault of the Beaumont Bank; and,
WHEREAS, since acquiring the property, the Beaumont Bank has
maintained it in compliance with all City ordinances; and,
WHEREAS, the Beaumont Bank wishes to secure the release of the
liens in order to clear the title to the lots for sale of the
property to a prospective developer; and,
WHEREAS, the Beaumont Bank has tendered to the City an offer
for release of the liens in the amount of $2, 475 , which amount
would be sufficient to enable the City to recover all costs
associated with the liens, including administrative costs as well
as mowing costs, plus a reasonable payment in lieu of interest;
and,
WHEREAS, it would be in the best interest of the City of
Beaumont to accept the offer for release of the liens in that it
would mean full cost recovery for the City and promote community
development by restoring the property to a productive use.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT:
THAT the appropriate City official be, and is hereby, authorized
to execute a release of the weed cutting liens against property
described in Exhibit A in consideration of a payment in the amount
of $2,475 from the Beaumont Bank.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the
6th day of June 1989.
