HomeMy WebLinkAboutRES 89-093 JP q- 93 R E S 0 L U T 1 0 N WHEREAS, the City Council of the City of Beaumont deems it necessary that M. L. King, Jr. Pki7y./Spur 380, in the City of Beaumont, Jefferson County, Texas be located, constructed, widened, extended and maintained; and, WHEREAS, said City Council has found that a public necessity exists requiring the location, construction, widening, extension and maintenance of said street on the hereinafter described property; and, WHEREAS, the City Council deems it necessary to acquire the hereinafter described interests in and to the hereinafter described property for said location, construction, widening, extension and maintenance of said street, and has found and determined that said interests in and to the hereinafter described land is suited for such purposes and that it is necessary to acquire same for said purposes; and, WHEREAS, the City of Beaumont, through its duly authorized representatives, has negotiated in good faith with the owners of the hereinafter described land and has been unable to agree with such owners of such property as to the fair market value thereof and damages, if any; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Attorney be, and he is hereby, authorized and directed to file or cause to be filed against all owners of the following parcels of land, and all claimants of any interest therein, proceedings in Eminent Domain to acquire fee title for said purposes, in and to the said parcels of land described in Exhibits "A" attached hereto and made a part hereof, the parcel of land being situated in Beaumont, Jefferson County, Texas. PASSED BY THE CITY COUNCIL of the City of Beaumont this the —25th day of April 1989. Mayor 2 DESCRIPTION Parcel 353 Being 1.3774 acres of land, more or less, being all of Lots 1, 2, 3, 9, 10, 11 , and 12, and part of Lots 4 and 8, and that part of alley closed in Volume 1118, Page 404 which is adjacent to said Lots, all out of Block 67 of the Van Wormer Addition to the City of Beaumont , Jefferson County, Texas , according to a map or plat of said Addition recorded in Volume 1, Page 16, Map or Plat Records of Jefferson County; and being part of the same land described in a deed to Heisig Storage and Transfer Company, Inc. , dated August 3, 1973, as recorded in Volume 1795, Page 242, Deed Records of Jefferson County, Texas , said 1.3774 acres of land, more or less, being more particularly described by metes and bounds as follows: Commencing at the northwest corner of said Block 67, same being in the south right of way line of Fannin Street; Thence North 45°59'59" East along said south line of Fannin Street a distance of 150.00 feet to the Point of Beginning in the proposed west right of way line of Spur 380; Thence South 25°33'56" East along the proposed west right of way line of Spur 380 a distance of 316.23 feet to a point for corner in the north right of way line of Forsythe Street; Thence North 45°59 '59" East along said north right of way line of Forsythe Street a distance of 250.00 feet to a point for corner in the existing west right of way line of Railroad Avenue; Thence North 44°00111" West along said west right of way line of Railroad Avenue a distance of 300.00 feet to a point for corner in the south right of way line of Fannin Street; Thence South 45°59 '59" West along said south right of way line of Fannin Street a distance of 150.00 feet to the Point of Beginning and containing 1.3774 acres of land, more or less. AND IN ADDITION THERETO: Title to all of warehouse "A", being a brick warehouse on concrete piers, and warehouse "B", being a metallic warehouse on concrete piers; each of which are located partially on the remaining property of which the above described property was originally a portion; said warehouse "A" being traversed by the proposed west right of way line of Spur 380, which line enters the north side of warehouse "A" ninety-six and five tenths feet (96.51 ) east of the northwest corner of said warehouse "A" and leaves said warehouse sixty-seven and ninety-four one-hundredths feet (67.94' ) east of the southwest corner of said warehouse; and said warehouse "B" being traversed by said proposed west right or way line of Spur 380, which line enters the north side of said warehouse one hundred and thirty-nine and fifty-two one-hundredths feet (139.52' ) east of the northwest corner of said warehouse and leaves said warehouse one hundred and thirteen and three tenths feet (113.3' ) east of the most westerly southwest corner of said warehouse, with the results being that the portions of said ware- houses lying west of said proposed west right of way line would be in such con- dition that they could not be adequately reconstructed at this location; plus the temporary right to enter upon the property remaining of which the above described premises were originally a portion , for the sole purpose of removing all of said warehouses.
