BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT:
THAT the City Manager be, and ',ie is hereby, authorized to execute
aln interlocal agreement with Drainage District No. 6, a copy of
which is attached hereto as Exhibit "A" , foi construction of a
bridge on Sherwood Drive.

INTERLOCAL AGREEMENT
THE STATE OF TEXAS
COUNTY OF JEFFERSON
This Contract is made by and between the City of Beaumont, a
home rule City of the State of Texas (hereinafter called "City") ,
and Jefferson County Drainage District No. 6, a special district
of the State of Texas (hereinafter called "District") under
authority of the Inter-local Cooperation Act, Texas Revised Civil
Statues ANN. Article 4413 (32c) . The City and the District agree
as follows :
WITNESSETH:
The City and the District agree there is a need to replace the
existing box culvert crossing at Sherwood Drive and Ditch No. 900
with a clear span concrete bridge and to concrete line approxi-
mately 225 feet of the ditch from the end of the existing lining to
100 feet downstream of the Sherwood Drive bridge in the City of
Beaumont.
The City and the District agree to share the total cost of this
project on the following basis:
1. District will engineer and design the structure.
2. District will coordinate and manage the project
during construction. Upon completion and
acceptance of the project, City will maintain
the bridge replacement crossing and District
will maintain the open ditch portion of the
project.
3. Except as provided below, the City and District
will each bear 50% of the cost of this project.
4. District will render a monthly billing to City
for 50% of the monthly payments made by District
under the construction contract as well as pay-
ments made for engineering and other costs
related to the project , with payment of same
from the City within twenty (20) days of receipt
of billing .

5. The cost of relocation of City owned utility
lines and/or structures, if any, will be borne
by the City. The cost of all other utility
lines and/or structures will be shared equally
by City and District.
6. The cost of providing barricades, traffic re-
routing , public notice and other related items
shall borne equally by City and District by
including same in the construction contract .
7 . The District will receive credit for engineering
fees all ready expended in analyzing this problem
against monthly cost sharing billings until this
expenditure has been exhausted . Data and design
work all ready completed will be forwarded to
the City.
8. The City will be invited to give input and review
for the bridge structure prior to the finali-
zation of plans and specifications for the project .
9. The District will receive bids and select the
best after reviewing said bids with the City.
10. The City will be listed as additional insured
on the contractors insurance certificate.
