R E S O L U T I O N
WHEREAS on December 10, 1986 , a contract was executed
with Speedway Service Company, Inc. to construct drainage
improvements in the Minglewood Addition for the amount of
$69,826 . 60 with the project completion date not to exced sixty
( 60 ) working days; and,
WHEREAS, on May 18, 1987 , the City Manager authorized
Change Order No. 1 decreasing the contract amount by $3, 648
making the new contract amount $66 , 178 ; and,
WHEREAS, on July 22 , 1987 , Speedway Service Company,
Inc. was removed from the project by its own bonding company, The
Aztec General Agency, for nonperformance; and,
WHEREAS, construction is now complete at a final
estimate of $61 , 337 . 61 ; and,
WHEREAS, the contractor overran the working days by 59
and was assessed liquidated damages of $9 ,086 making the final
construction costs, less liquidated damages, $52,251 .61 ;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BE.AU.MON:
THAT the City Manager be, and he is hereby, authorized to make
final payment to Speedway Service Company, Inc. and the Aztec
General Agency in the amount of $3,811 . 35 for construction of
drainage improvements in the Minglewood .Addition.
PASSED BY THE CITY COUNCIL of the City of Beaumont this
the day of 1988 .
