R E S O L U T I O N
BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT:
THAT the City Manager be, and he is hereby, authorized to execute a
Release of a Platted Drainage Ditch substantially in the form as
attached hereto as Exhibit "A" .

WHEREAS, First City Bank-Gateway, N.A. is the current fee owner of
that certain 4 . 443 acre tract of land out of Emma Reed Addition, an
Addition to the City of Beaumont, Jefferson County, Texas as said tract
is more particularly described on metes and bounds attached hereto and
incorporated herein as Exhibit "A" , said tract being also known as the
Ridgewood Motel Tract; and
WHEREAS, said tract includes a portion of Block Four (4 ) of said
Emma Reed Addition, together with a portion of Maple Street (now
closed) and Isla Street (now closed) as shown on the plat of Emma Reed
Addition recorded in Vol. 7 page 10 of the Map Records of Jefferson
County, Texas; and
WHEREAS, the aforementioned plat of Emma Reed Addition has shown
thereon a drainage ditch which crosses portions of the tract described
on Exhibit "A" attached; and
WHEREAS, the drainage ditch shown on said plat is no longer in
existence and has not been in existence for at least the period of time
since the construction of the Ridgewood Motel on the subject property;
and
WHEREAS, it is the request of the current fee owner of the subject
property to set forth of record that the undersigned party claims no
interest or rights into portions of the subject property contained
within the boundaries of the drainage ditch area shown on the plat of
Emma Reed Addition;
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS : That the City of
Beaumont, acting by and through its duly authorized officer, for good
and valuable consideration, including the removal of any cloud on title
which may exist by virtue of the above stated facts, hereby releases
and quitclaims all of its rights, title and interest to the current fee
owner of any portion of the property described on Exhibit "A" attached
hereto and incorporated herein which may lie within the area designated
as drainage ditch on the plat of Emma Reed Addition as recorded in Vol.
7 page 10 of the Map Records of Jefferson County, Texas.
