HomeMy WebLinkAboutRES 86-311 R E S O L U T I O N WHEREAS, State law presently allows certain land uses which may have a significant impact on a neighborhood to be located in a city without compliance with local zoning restrictions. An example of such special treatment is Senate Bill 940 which makes group homes with less than six (6) disabled residents a use of right in any residential zone; and, WHEREAS, this special legislative exemption from local zoning goes beyond the requirements of constitutional law; and, WHEREAS, the City of Beaumont wishes to request the legislature to reconsider its legislataive enactment and amend Senate Bill 940 to provide that group homes are permitted uses in all zones except single-family residential zones; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City of Beaumont hereby expresses its concern relating to Senate Bill 940 and similar laws which limit city zoning control and hereby requests the legislature to amend such laws to protect single-family residential neighborhoods from the location, as a matter of right, of land uses such as group homes which have an impact on neighborhoods which is greater than traditional single-family uses.
