WHEREAS, Mobil Oil Corporation has requested the City of
Beaumont to allow the installation of a fence on the north and
south sides of Sulphur Drive, 25 feet into the street right-of-way
to deter swimming and dumping activities in the canal; and,
WHEREAS, City staff has expended considerable time and
effort in investigating the effect of such encroachment upon the
City and utilities serving the same; and
WHEREAS, it appears that it would be equitable to allow
such encroachment at this time;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager is hereby authorized to execute a License to
Encroach for Mobil Oil Corporation to encroach upon the north and
south sides of Sulphur Drive, 25 feet into the street right-of-way
to deter swimming and dumping activities in the canal . Such
agreement shall be executed in return for a one time license fee
paid to the City of Five Hundred Dollars ($500.00) .
