HomeMy WebLinkAboutRES 86-153 R E S O L U T I O N WHEREAS, on September 20, 1983 City Council passed a resolution awarding a bid to C & P Equipment Corporation for Contract 16, Separation Sewers South in the amount of $1 ,463,914. 35 ; and, WHEREAS, in May, 1984, C & P Equipment Corporation abandoned the project and it was subsequently assigned to Sterling Utility Construction, Inc . on June 26, 1984 as agreed to by the City of Beaumont and Union Indemnity Company of New York, C & P Equipment Corporations' s surety company; and, WHEREAS, Union Indemnity Company required the city to pay them all monies owed to C & P Equipment Corporation and they would pay all outstanding debts owed by the contractor; and, WHEREAS, Union Indemnity Co . was placed in liquidation in 1985 before all claims had been settled and the City Attorney recommends placing the $35,983.23 in an escrow account until a court settlement is reached in Union Indemnity' s bankruptcy case; and, WHEREAS, Change Order No. 1 provides for the adjustment of bid quantities to as-built quantities, adjusts the contract price for necessary extra work items, increases the contract time due to bad weather, establishes the project completion date, provides for the escrow account for the $35,983 .23 and provides for final payment of Five Hundred Dollars ( $500) to Sterling Utility Construction, Inc; NOVA, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be, and he is hereby, authorized to execute Change Order No. 1 to the contract between Sterling Utility Construction, Inc. and the City of Beaumont for Contract 16, Separation Sewers South decreasing the amount of the contract to $1 , 371, 653.77 and making final payment to Sterling Utility Construction, Inc . in the amount of $500.
