WHEREAS, right-of-way purchased for Spur 380, Phases I
and II, was purchased in the name of the State of Texas; and,
WHEREAS, in Phase III, the right-of-way will be purchased
in the name of the City of Beaumont and a portion of the property
acquired will be granted as an easement to Kansas City Southern
Railroad for railroad relocation; and,
WHEREAS, after the easements are granted, the City will
deed the property to the State subject to the easement and request
reimbursement; and,
WHEREAS, this process is necessary so as not to delay the
timely completion of the project;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the purchase of the following parcel of land is hereby
approved:
Parcel 51: 7,000 square feet out of the David
Brown League, Abstract 5 being all
of Lot 14 of Block 35, Arlington
Addition
Owners: Herman Myers, Leroy Myers
and Clem Albert Myers
State' s Approved Value: $7, 240
Parcel 52: 2,923 square feet out of the David
Brown League, Abstract 5, being
part of Lot 15 of Block 35,
Arlington Addition
Owners: Don L. Garcia and Ruby M.
Garcia
State' s Approved Value: $5,500
Parcel 130: 6, 787.6 square feet out of the David
Brown League, Abstract 5, being all

BE IT FURTHER RESOLVED that the City Manager is hereby
authorized to execute easements and deeds as necessary to
accomplish the purposes set out herein.
